BREAKING: Take Two Sues Jack Thompson over Manhunt 2, GTA4

March 16, 2007 -
In the wake of a recent legal threat by Miami attorney Jack Thompson (left), game publisher Take Two Interactive has launched a pre-emptive strike.

With Thompson threatening to file suit to block the release of Grand Theft Auto 4 and Manhunt 2, Take Two has petitioned the United States District Court for the Southern District of Florida for relief.

The software publisher seeks to block Thompson from trying to have the games declared a public nuisance under Florida law. Thompson filed a similar action against Take Two's Bully last October, but a Florida judge rejected Thompson's contention, allowing Bully to be sold by retailers.

In its complaint, Take Two claims the action is necessary because:
Thompson has a history of making multiple threats of legal action, whether substantiated or not, both against (Take Two) as well as the retailers who purchase the video games and offer them for sale to the public. Thompson has made such threats again in connection with Manhunt 2 and GTAIV...

The suit alleges that Thompson's public nuisance tactic violates Take Two's First Amendment rights. Lawyers for the game publisher argue that the Florida statute under which Thompson is seeking to have the games declared as nuisances essentially makes the controversial lawyer "a private attorney general on behalf of the State of Florida."

Take Two is also seeking to recover from Thompson its attorney fees and other costs incurred related to the pending legal action.

For his part, Thompson criticizes the Take Two complaint in a writ filed with the Florida Supreme Court, and rather dubiously takes credit for a recent shareholder revolt which is expected to result in the firing of CEO Paul Eibeler as early as next week. The attorney writes:
So successful has Thompson been in exposing the fraud and criminal conduct of Take-Two on the national stage... that a corporate coup by 46% of Take-Two’s shareholders is set for March 23, which nearly all financial analysts... are predicting will be successful and which will result in the firing of all Take-Two management and the entire board...

C-C-C-COMBO BREAKER!

I'm glad a video game company finally grew some testicles and took action against JT pre-emptively.

What I think is contriversial is the fact of Jack also trying to take Bill Gates/ Microsoft to court if they release this game on the 360 console, but mentions nothing about Playstation 3. He is personally attacking microsoft/ Xbox. Saying he will do whatever, by all means, to make sure GTA IV does not come out on the X-Box, attacks Gates, but in every referance mentions nothing about GTA for Playstation 3. They might bring that up in court as well....

When I heard this I was tickled pink. This jackass has had it coming for a long time and finally he gets what he deserves. I hope TT sues for damages and sends him right into Chapter 11.

You have to realize that the only thing Thompson loves more than attacking Take Two, is getting himself in the media. He wants his face on TV, he wants his name in the papers. The guy gets off on his exposure ever since he attacked Reno all those years ago

why is gta and manhunt trageted? HAVE YOU EVER FKING PLAYING SOCOM OR GHOST RECON OR RAINBOW SIX? those games show you EXACTLY how to plan and execute murders/robberys/building take overs, ect. they show you realtime plans for what jackie boy thinks is violence.. OHHHHHHHHHHH BUT I GUESS ITS OK SINCE IN THOSE GAMES ITS THE ARMY N SUCH AYE?

hypacritical peice of crap, thats what jack thompson is.

I just hope take two is careful not to make a martyr out of this guy.

Yo,
This guy is another over-conservative fear monger. It seems the US breeds them. Videogames don't make people go crazy and kill people. Life does enough of that on it's own(making people crazy).

fight fear-mongering!

@Gameboy/Kuri:

Actually, regarding Oblivion, I don't think Jack ever made any mention of Bethesda Softworks in that instance; Oblivion was in fact published by 2K Games, which I believe is owned by Take Two. That's why he went after that over that nude mod.

It's great to see they've finally taken off the gloves and fought back. And ol' Jacko can't accuse them of being the 'violent, evil and bloodthirsty monsters' he claims them to be. They're using legal, non-violent actions to shut his yap.

Try and claim agression on this Jacky boy! :p

I hope this will make ye olde Jack finally shut his mouth. He's a pain in the ass for all gamers and the whole game industry. His statement of games making people violant doesn't even has proof of being true.

Will someone just take a bat to this fool's head and show him what a real upset gamer will do? He thinks we're all crazed violent psychos, someone should prove him right. Just Once.

Well, first time on this forum, so here goes.

We had the same uproar when TV dared to show nudity, violence and various other things deemed nasty or unwholesome. Cinema has been trying for decades to break the barriers of convention. So the liberals win, a watershed is introduced. The parents are the arbiters and enforcers of said watershed. The child demands a TV for their room, and the watershed is defeated, because we cannot tell the kids what to do anymore.

The liberals defeat their own agenda.... again.

I've been playing games on home computers and consoles since 1981. I've seen it all. I've played most of the controversial titles. In Britain, we had a game for the Sinclair ZX Spectrum called Death Wish III, which features MINDLESS violence. The liberals want the title removed from all shelves and a ratings system introduced. Very publicly. The publicity generated for this criminal masterpiece was phenomenal, and the game sold by the shedload!

Liberals 0-1 Games Industry!

I played it when I was 14, and I didn't feel any urge whatsover to kill anyone. Amazing!

Grand Theft Auto for PS1 received an '18' classification in the UK. And rightly so. It featured all the things you shouldn't be allowed to do in real life. It was also funny and very tongue in cheek. And, surprisingly, it was aimed squarely at a generation of games palyers who had reached the age of consent. New Adults. People with the right to choose for themselves.

By this time, I'm 28, and responsible, and gainfully employed, with no vices other than Nicotine and Alcohol. Did the game make me want to steal cars and gun people down? Nope.

I'm sick to the back teeth of people like Jack 'Holier than Thou' Thompson. I agree with him in so many ways; video games rating, criminal charges against those whole sell illicit games to minors, etc. But I have to say this: Videogaming is here to stay. Videogaming is a viable entertainment media.

The people who revolt against this new media have never played, or if they have tried to play, are frustrated at their shabby hand-eye co-ordination, or their lack of problem solving skills, or their inability to think strategically. Worst of all, they appear to have no truck with videogaming as a media because they fail to see the possibilities and are impervious to FUN!!!

Rant made off!

Good Afternoon.

[...] For years, Take-Two Interactive has been on the receiving end of legal actions by gaming violence critic Jack Thompson. Now, though, the publisher is taking a proactive tack in its ongoing dispute with the Florida lawyer. As reported by GamePolitics, Take-Two earlier this week filed a complaint against Thompson, seeking to preempt a repeat of last year’s legal battle to keep the schoolyard action game Bully from being banned in the state. [...]

Brilliant. Hope Take 2 win (also hope their management are totally replaced and the "old family firm" is finally put behind them) these things are two separate issues, something that JT does not want us to see. Not that I *personally* approve of canis canum edit / manhunt / GTA as I hate the violence, misogeny and pure bad taste in them. But i'll defend anyone's right to make that decision for themselves.

if GTA IV was banned because of him , i wud personaly hunt that fucker downy and fukin drown him : ) any1 agree ? ...Hmmmm anyone want to start a cult lol ... anti - anti GTA

God, I hate Jacko. GTA is great, he is a blood sucking lawyer desperate for "easy" money. What a douche!

I guess that shoots down my theory that Jack was actually am employee of the company, working to raise awareness of TT games through his own stupid humiliation.

[...] Take Two, the company that brought us Grand Theft Auto, recently sued our good friend Jack Thompson to try and stop him from having GTA4 and Manhunt 2 declared as public nuisances. The instrument they’re using is none other than the First Amendment - you know, the one about freedom of speech. [...]

[...] Take Two Sues Jack Thompson Need I say more? Take Two Sues Jack Thompson And the publisher comes out swinging with haymakers! By Dan Dormer, 03/16/2007 GamePolitics is reporting that the hunted has now become the hunter, as Take-Two has filed a lawsuit to prevent ol' JT from meddling with and potential blocking the sale of Grand Theft Auto IV and Manhunt 2 when they release later this year. Take-Two outlines in the suit (PDF) that He-Who-Must-Not-Be-Named has a history of blatantly threatening legal action (and also, losing) against publishers, developers, and retailers in the past. The legal document also goes on to state that JT is almost "a private attorney general on behalf of the State of Florida" given his attempts to censor Take-Two and Rockstar by having the games declared public nuisances. This isn't a surprising move, given that Take-Two probably wants to streamline the legal process because you know JT would have sued them eventually. This just speeds up the process, and helps with the eventual disbarment of everyone's favorite bark, but not bite Floridan attorney. Take Two is suing Jack Thompson? Woah. Did I wake up in Bizarro World this morning? This is very... just... weird. Oh well. I hope TT wins big.

You know, depending on how the Florida courts feel about this man is going to determine how this case turns out. From what I can see JT turns the Florida courts into a circus everytime he files suit and the court system doesn't appreciate it. That feeling will definitely show in the ruling of this case.

@ kurisu7885

I completely forgot about the Sims and Oblivion attacks. But did he actually file a suit against them? I don't recall it if he did. Or maybe he just didn't fall through with it like Take Two says in their complaint (it says he has a history of dismissing suits weeks after he initiates them; Page 6, Paragraph 23).

the guy has a real habit of thinking he can predict the future, the majority of his actions with the whole bully case happened before the game was even released to the public. i find this mind-numbing, even if the content of the game was obvious, or even legit for that matter, i cant see how something can be declared a public nusiance before the it has a chance to reach the public to begin with. protesting against something is one thing, trying to get it banned so that no one can get their hands on it, children or adults is just stupid. this guy is digging his own grave and i see no reason to stop him, its more funny when he finally realizes that he screwed himself so far under than to have us tell him anyway.

[...] PD: Hablando de Jackass Thompson, alguien está a punto de devolverle el disparo al mejor estilo GTA. [...]

The only way this can get better is if all the businesses he's harrassed over the years (BestBuy, Walmart, etc) joined in for a class action suit!

@Rob Allen

You have a very good point there. For a moment, I was wondering if it was in fact the new board doing this to Thompson. Apparently, the previous board never would've done that.

I really wish Take 2 wouldn't lie in court filings, it weakens their case.

"Thompson has a history of making multiple threats of legal action, whether substantiated or not,"

When has he filed a substantiated claim?

all GTA games are crap

[...] US, March 16, 2007 - Take Two and Jack Thompson have a long history together. But usually it's Thompson attacking the publisher, not the other way around. The Florida attorney has declared his intentions to try and block the sale of Take Two's upcoming games Grand Theft Auto IV and Manhunt 2. The company has apparently decided it's not going to take Thompson's attacks lying down, and has filed a preemptive motion with the U.S. District Court for the Southern District of Florida to silence Thompson's complaints. GamePolitics has reported that Take Two filed its petition on March 13. The motion states that Take Two is "seeking declatory and injunctive relief against Defendant John B. Thompson, to enjoin him from bringing suit on behalf of the State of Florida to enjoin the sale of GTAIV or Manhunt 2 as a nuisance." Take Two presents this action as necessary because "Thompson has a history of making multiple threats of legal action, whether substantiated or not, both against (Take Two) as well as the retailers who purchase the video games and offer them for sale to the public. Thompson has made such threats again in connection with Manhunt 2 and GTAIV

As a gamer myself, I think Jack is..how do i put this politely... .... ...a jackass, I personally play violent video games to get rid of anger, to make money, to have fun, if anything violent video games make me happier because i use it as stress relief. why shold violent video games be banned from all of us? If the parents think the violence in video games is bad for the children, let them govern their own kid and no one elses! I think video games are an expression of art, of teamwork, if you took photography in high school and looked through those books looking for ideas you would notice lots of naked women, why dont they ban that? because its art, just like video games, video games are nothing more than pictures rendered by a computer. Ive been exposed to video games all my life, im from the nintendo generation, ive seen video games evolve from black and white dots to beautifully rendered 3 dimensional graphics, i dont see a reason why Jackass Thompson should be banning something as beautiful and ecomically important to the world as video games, without them some pretty weird stuff would happen, i hypothesize that there would be no reason for faster, more powerful computers, gaming is one of the very few, if not the most important in pushing technology forward

I'll also add to my comment that he's also attacked Id software, saying they and they alone were responsible for the Columbine shooting using Doom

What the...? A pig just flew by my window...

@hilaryduffgta:

It's good to have you back. I loved reading your discussions with Yuki. Those where aways intresting comments and thought provoking as well as your sarcasim.

Wow, I wouldn't want to be this asshat's son :S

Thank God I ain't.

"However, all costs have to be ‘reasonable’ for the action. Things like rediculous costs (hiring 28 lawyers) will not be awarded by the court. Then again, if the losing party was exceptionally unreasonable (delaying, not producing proper documents, wasting court’s time…) then the cost award will increase."

Which Jack has done, numerous times.

"Only one problem with your idea. There are no other companies that could sue him! He really only attack Take Two and Rockstar. Ever heard of Jack attacking Eidos, Naughty Dog (even if just based on the name), Square-Enix or any other company? He literally attacks Take Two exclusively. They really do have a harrassement case against him."

Actually, Jack has also attacked Bethesda softworks and EA games over a nude mod that was made for Oblivion and over The Sims because users had made pornographic content, so there are at least two other companies

@Forbes Buck

Actually, he claimed it was satire, which I think is worse ,since it makes it seem like he thinks charities are a joke. And Gabe and Tycho make millions with their own charity, Child's Play, so ten grand was likely pocket change compared to what they give, and odds are Jack wants Child's play shut down too.

PLEASE LET JACK POST HERE AGAIN. This opportunity is simply too amazing to miss.

Please!

PLEASE!
