In Countersuit, Thompson Claims Take Two at Center of Vast RICO Conspiracy

Last week GamePolitics broke the news that troubled game publisher Take Two Interactive had filed suit against anti-game activist Jack Thompson in Federal District Court in Florida.

Late yesterday, Thompson sent out e-mails containing a copy of his response to Take Two’s suit as well as a counter claim which, among other things, alleges the Grand Theft Auto publisher is at the center of a vast conspiracy to deprive Thompson of his civil rights.

Referring to Take Two in the court filing as “thuggish pornographers,” Thompson charges that the company violated federal RICO (Racketeer Influenced and Corrupt Organizations Act) statutes, commonly used to prosecute organized crime syndicates.

Among Thompson’s claims:

Take-Two has, since July 2005, been at the center of an effort to violate Thompson’s civil and constitutional rights… In addition to… extortion (intimidation) of Thompson… Take-Two has committed other predicate RICO acts, including but not limited to fraud, distribution of obscene and/or sexual material harmful to minors…

Additionally… Take-Two, through its Blank Rome lawyers, sought in Alabama to tamper with a witness in a pending criminal case, according to that witness’ lawyer.

Neither the witness nor the lawyer are named in Thompson’s filing. The Alabama reference would be to the Strickland vs. Sony case in which an 18-year-old GTA player killed two police officers and a police dispatcher. Thompson represents the families of the victims in a $600 million lawsuit against Take Two, Rockstar, Sony, Wal-Mart and GameStop. The judge in that case, however, revoked Thompson’s pro hac vice (visiting) admission to the Alabama Bar in November, 2005.

Later in the 37-page filing, Thompson adds perjury and obstruction of justice to his allegations against Take Two. He claims that Take Two has “collaborated and conspired with third parties to commit these racketeering activities.” As alleged by Thompson, these “third parties” include many influential video game websites and publications, including this one as well as Kotaku, Joystiq, GameSpot, IGN, Penny Arcade, EGM, Game Informer and Spong.

Thompson also claims that game industry groups including the ESA and ESRB are involved as well as consumer group the Entertainment Consumer Association (ECA). The ECA is the parent company of GamePolitics.

As much of a jerk JT is, no one should ever wish those things on anyone. He’s still a human being. Just a really really nutty one.

    That may be the single worst legal document I’ve ever read. I’ve not read many, but still. Compare to T2’s original filing. It’s concise. It cites precedent. It confines itself to facts and legal arguments.

    Laddy Jack’s… does not. I don’t see how anyone, judge or jury, would be able to take his countersuit seriously. That’s assuming it even gets tried. It almost certainly won’t. Maybe he’ll get a discovery fishing expedition, trying to prove a link for his conspiracy, but my gut says that this will just get flat out dismissed as without merit.

    Of course, predictably, he’s misreading it. It says that during a 2005 survey of 406 stores, 42% of the attempts of a minor to purchase a Mature game were successful.

He misses basic things like state citizenship, makes claims that directly contradict the legal record, such as he was only trying to prevent the sale of Bully to minors when public nuisance law makes no such provisions, which is unsurprising as it wasn’t really aimed at products which are sold. He repeatedly said he wanted police to seize it. He makes numerous factually incorrect claims abotu Florida’s public nuisance law along things lines, claiming the standard for being a public nuisance is being harmful to minors, which it isn’t. In fact, this is essentially the whoel basis of his suit. He is claiming Take 2 wants these game to be ruled to not be public nuisances on the basis that they are nto harmful to children when the actual reason they want is that public nuisance laws do not apply to video games as they aren’t written in a way that makes it clear how they would apply.

    I have no idea where he got the claim that 42% of M-rated game sales are to minors. THe total percentage of game sales to minors is much lower than this. so it can’t be correct. I am similarly puzzled about when Take 2 said they woudn’t advertise in public transportation. The whole document is filled with claims that feel like they ought to have a citation, but don’t. He doesn’t even properly reference the suits he was involved in and misrepresents a lot of the rulings.

    Argument 17 is especially absurd. Having to get court approval for speech is called prior restraint and very much not allowed under US law.

    I assume the racist claims about Scots were an attempt at irony, which is not something usually engaged in in court filings.

    The saddest thing is I think Thompson actually believes the claims he makes.

    There are some things in Thompson counter-suit that just doesnt make any sense. If he is responding point by point to T2’s claim then the following make no sense (in short):

    T2: Thompson seeks to regulate the expressive medium of videogames and limit access to certain videogames based solely on the content of the expression depicted or contained there in.
    JT: Denied.

    T2: Videogames are a form of artistic expression, with extensive storylines and developped characters. Videogames explore the same themes and plots as other forms of literature, such as good versus evil, the corruption of governmental authorities, or the life of criminal.
    JT: Denied.

    T2: Videogames also contain extensive visual, graphic, animated and computer generated artwork, as well as original scores and songs.
    JT: Denied.

    And a lot of others regarding legal issues. Seriously, how can someone denied there is artwork and music in videogames?

    Really? I think the saddest thing is that this court filing reads like one of Thompson’s press releases or an excerpt from a book or article by him or an interview of him. That it cites actors portrayals of whistle blowers in Hollywood movies, but at a glance through doesn’t seem to properly cite any court cases or precedents. That it’s an actually filed lawsuit with the court – complete with Thompson’s lawyer listed at the bottom – that bears only a passing resemblance to pretty much every other legal document I’ve ever seen.

    I think the fact of the matter is here is that JT’s case basically reads as ‘I want Take Two to be singled out and have to produce all it’s mature games to a court for judgement before release, and if they don’t accept, they’re mafia.’

    It also says the Columbus teen said “Video games made me do it” after Thompson pulled some strings, then Thompson has the nerve to say Blank Rome was witness tampering. Just like with the lyrics of the season one opening of Rowin Atkinson’s The Black Adder, the pot is blacker than the kettle.

He is like the type of person who would knock on your door to tell you that you can only be saved by God if you go to his church “and sit” next to him and donate 11 percent instead of 10 percent and if you say something is cooking or your busy he would speak faster and make statements like:

    No, no…sueing him isn’t the way to go, if you were to take activism. You need to do something else. It’s like this; the courtroom is his territory. Sure, he doesn’t necessarily hold as much strength as he thinks, but instead, you want to get at him in a way more of us are much more familiar with than he is, basically, you got to use our territory, and the real world outside of the courtroom where, in the end, you hold higher power. For example, if you were to start a rally, y’know, outside, he really couldn’t do anything about it I don’t think, and can make all the threats he wants. And that’s why you want people to gather as much information and records as possible, and should he by some chance appear in person, have video cameras to just in case, and use the gathered information to demostrate his attitude in full light. Basically, a public protest or the likes would be better than dragging lawsuits into it.

    Not just public perception. A SCOTUS ruling extended 1st Amendment protection to video games on the basis of just that, so not only is JT out-of-touch with reality (which is far more common in people than we like to admit), he doesn’t know the rulings of a higher court which he plain out “Denied.”

    His entire filing is simple rhetoric. A simple kiss is equated to “Homosexual Sex.” (BTW – as we learned from Bill Clinton – oral sex is not legally “sexual relations”) He purports that there is “Oral and Anal Sex,” in the Hot Coffee scenes, which is fully misleading because the scenes on the disc are both fully clothed and contain no anal sex. He uses anecdotes and quotes from literature instead of citing precedent. He tries to take the reader on an emotional journey, and this is risky because of it’s slippery slope nature. If TTWO’s lawyers can show only one or two points of his to be wrong, the reader (a judge) will then be ultimately skeptical from there on out. He is masterful at loaded language, but this has no place in a court filing. In fact, most judges I know would be secretly insulted by the lack of professionalism in the court that this filing spews.

    Putting all the rhetoric issues aside, his case his little merit because he outright denies standing precedent with no reasoning to why this would be a vaild point.

    Personally, I think JT knows his legal days are numbered, and so he wants to go out a martyr. I fully expect him to be held in contemt during this case, which he wants to add to his christian persecution complex.

    Most people who martyr themselves do it with the assumption that someone else will be inspired enough to take up their cause in their place, picking up where they left off. Somehow, I don’t see that happening with JT.

    It’s clear by now that no one likes him. Whatever allies he once had have been alienated by his behavior. What little he has left, like the Peaceoholics or the Eagle Forum, are fringe groups which hold very little influence. He’s made many enemies in the judicial system, his fellow lawyers regard him either as a joke or an embarassment, he’s burned bridges with several politicians (depsite his statements to the contrary) and even the press is starting to get tired of his antics as word spreads of how crazy and unprofessional he is.

    If he going to be a martyr, he’ll be a very lonely one, and I don’t see many who would be eager to replace him, much less be as shrill or as crazy as he is. The only one I can think of off the top of my head would be Dave Grossman, but he’s pretty much dropped out of sight and doesn’t seem eager to come back.

    As games continue to become more accepted as mainstream enterainment, become more ubiquitous and more politicians are sarting to come around to the fact that they may not be so harmful after all, JT’s point of view becomes less and less relevant. If anything he’s becoming percieved more like Don Quixote; tilting at windmills he thinks are giants while everyone else comments about how crazy he is. If he were to be taken out tomorrow, I don’t think many tears will be shed, and that most will say he had it coming. In fact, I can only see the dialogue improving if he were removed from it, as we would no longer have to put up with his lies and be distracted by his histrionics.

    Most likely, he’ll be a martyr only in his own mind. He’ll see it as committing “revolutionary suicide protesting the conditions of an inhumane world.” But it will ultimately be a worthless gesture.

    I doubt he’s misreading it. It’s a deliberate attempt to mislead, and if somebody calls him on it THEN he can say “oh, I must have misread it”.

    He may be a jackass but he’s definitely not stupid. Every word that comes out of his mouth is intentionally misleading. Theres nothing worse than a compulsive liar with an agenda.

    At this point, I honestly just laugh. I mean, I saw this piece of news, and I literally just lost it laughing at work (got some funny looks, too. Oops.). When I got home and read through some of the filing, I lost it again. I’m convinced that Jack Thompson is really just a comedian impersonating a lawyer, because I don’t see how he could be so unintentionally funny.

    After I read about this on Gamespot yesterday, I can’t help but wonder if this is what he’s really wanted all along. To hear him, you’d think us gamers and the game developers, publishers and advocacy groups are the most evil people in the world. What have we ever done to deserve this?

    I once talked to my father, who also lives in FL BTW and is a religous man himself, about him. And he said that this is someone who’s clearly lost his way, and that he’s going to pay for it sooner or later whether he realizes it or not. We both agreed that he is going to lose his entire family over this, and that he will realize too late that he threw it all away over this ultimately worthless “crusade.” Then again, he may never.

    A couple weeks ago I saw a documentary on Jim Jones with his son being one of the people he interviewed. Basically, his son said that he was repulsed and embarassed by his behavior and felt no sadness or sympathy for him when he died. That feeling was saved instead for the hundreds of people he had lied to and manipulated. I have to wonder if Thompson’s own son harbors similar feelings? At least Thompson won’t have as many people around him to drink the Kool Aid as he pursues his own self-destructive path.

    What I find most interesting though, is his complete misunderstanding of retail sales. He repeatedly (30 times at least) accuses TT of “distributing sexual material to minors”. Maybe he doesn’t realize it, but TT doesn’t sell games to anyone under the age of 18. How do I know this? Because there’s not a single Gamestop, EB, Bestbuy, Walmart, Kmart, etc. anywhere on earth that is owned or solely managed by a minor.

    His reponse is basically to repeatedly state that they are trying to sue him for a case he “hasn’t even brought yet!” which is precisely the point of the action, something that seems to elude him. He states opinion is fact, giving his usual rants about gamers being trained to kill on games and talks about his ’60 minutes’ interview a good half dozen times.

    This is quite a concise collection of his greatest hits. If the Judge sits down and reads through all 37 pages there is no doubt that Jack will have harmed himself before the case even starts. I reads like the ramblings of a madman. I genuinely suspect this could be his swansong.

    The ESRB ‘M’ Rating does NOT mean that it is harmful to minors, it means that it may be harmful to those not mature enough to handle the content. I would much rather have GTA in the hands of a mature 13 year old (yes, there is such a thing) than in the hands of a 30 year old psychopath.

    Since when was the sex in GTA-SA of the ‘backdoor’ variety? Is JT seeing something the rest of us didn’t (he obviously hacked his own copy of the game to know this)?

    Bully again and once again the ‘homosexual sex’ throughout the game claim. Erm, where?

    The removal of Testicals in Manhunt 2 seems to get him all going… I’m starting to see a pattern here.

    I’m now at the bits where JT says he has many successes against the games industry (but fails to list them) and all the stuff on studies proving that games make kids violent… same old same old.

    According to him, the whole civil rights thig was when he was a “student mayor” whatever that is. Sounds like it was a college project. That to me hardly counts as being a Civil Rights crusader.

    He repeatedly invokes the late great Ed Bradley, making it sound almost as if he was a personal friend of his (also trying to get sympathy on his side by mentioning his cancer including the “excrutiating pain” and fever). Other than JT’s word, is there any evidence that he had a sympathetic ear w/ Bradley? Or that Bradley indeed agreed with him? based on JT’s history of lying and exaggertion, however, I doubt it.

    JT also makes much of his wife’s illenss and that somehow Blank Rome knew about it, going as far as to accuse them of foreknowledge about this so they could deliberately serve the papers to his incapacitated wife and 14-year-old son, somehow knowing of her condition. Newsflash: having had experiernce with the court system, the court DOES NOT CARE what state you’re in when they serve you your papers. They serve them when they want to, even if you’re dead! (“Have you no decency” indeed! I recall myself on others asking that very same question of JT!)

    Finally, JT makes it seem somehow that this is related to the impending purge of T2’s board of directors, and that the stockholders plan to fire Blank Rome along with it. That this move is somehow some sort of last-ditch desperation ploy to “handle” him as he puts it. This sounds plausible, but how likely is it? As dissatisfied as the stockholders may be, i somehow doubt they’d throw the baby out with the bathwater and jettison Blank Rome as well.

    Just a few points to ponder. Any thoughts?

    Toward the end he accuses them of sending sex toys to his wife who has undergone cancer treatment! This is laying it on a little thick I think, and in the worst case is a libelous and slanderous accusation of harrassment. I do not condone this behaviour in any way, but perhaps Mr. Thompson should look at his own actions in making himself such a figure of ridicule and hatred when assigning blame for this. This is a man whose son dislikes him due to his behaviour, how does he think others are going to react when he stereotypes a massive section of the population and then lies about them and their passtime. This is a man who mocked and insulted a community who had lost a member due to suicide, I feel so sorry for his family that he has brought all of this upon them.

    He refers to the Hot Coffee material as containing anal sex. I’m no expert on this subject or anything, but how can he tell? Any pictures I’ve seen have featured the non-anatomically correct models from the game (sometimes fully clothed) simply moving beside each other in a way that looks like sex. I believe that the reason he refers to it as anal sex in particular is that he wants people to believe it is disgusting and is probably hoping for some backwards bigot judge to equate it with (gasp) unholy gay behaviour!

    I can’t see this going anywhere. If complaint of conspiracy by Thompson was thrown out before, then this has no hope as it’s an even grander, even more complicated and even more unbelievable accusation! Seriously, when people have had enough of you trying to harrass them and take action, and there are already (what is it, 6?) different complaints against you to be processed by the courts, and there exists a public record of all the stupid and offensive things you have done, the last thing you want to do is claim to be the victim of a grand conspiracy. That is akin to someone being found covered in blood and holding a knifewith several stabbed people around and saying “this is a conspiracy by the police, the media, and everyone else in the world”.

    However… one thing I did notice was Jack’s use of wording and phrases. Employing “murder simulator” “homosexual sex” and “harmful to minors” is clearly a sneaky way of trying to evoke a certain response from the reader. Maybe that kind of rhetoric is a common lawyer’s common trick, I don’t know.

    JT likes to think of himself as David fighting his own personal Goliath, but I think it’s more appropriate to think of him as Ahab going after his white whale. Though as it is I’m not about to bet the farm on who the victor of this will be. I think both of the claims are a bit overreaching, though JT’s is more so. His has a lot of opinions and emotional rhetoric (the stuff about 9/11 and Islamic fascists was especially bad, being highly emotional and being relevant only with the greatest of logical leaps) and if you cut through it all there’s not much there. In fact to me it hurts his case quite a bit – it greatly dilutes whatever his message is, so he talks about a whole lot while failing to actually make much of a point.

    Alright. So most everything has been said before. I read the filing, skipping over several sections that were repetitive (there was a lot of it). So, here’s my thoughts and observations.

    I noticed he linked his psychological study, claiming it to be a causal effect once more, not a correlationary relationship as was explained. I’m pretty sure that the APA clarified through Dennis that is was not claiming causation. However, we all know Thompson doesn’t believe what he doesn’t like, as shown by his attitude the next day.

    He’s openly racist, hypocritical, and alarmist. His use of speech when describing “sexual” content he doesn’t like (ie. kissing = homesexual sex, anal sex, etc.) is intended to shock. He brings in pages of quotes of important people, all unrelated to this series of events, in order to build up his own appearance. He repeatedly brings up violent crime that he claims as linked to violence in video games, no matter the game, in an attempt to legitimize his case, and demonize the entire industry.

    His claim that media, industry groups, and even webcomics are in a grand conspiracy against him, all at the behest of T2 and their agents, is laughable. I doubt any of the groups will sue him over it. If anything, I could see them being called in as witnesses to define their relationship with Thompson. Penny Arcade would have quite the tale to tell.

    His description of the harassment he has suffered is interesting. However, his listing is highly focused. T2 can easily wave it off as not their doing, no matter what. But I would enjoy them pointing out how some of those “deliveries” were in fact flowers from the gaming community, asking for an open dialogue, which he lashed out at.

    Then, we come to the final page. The very end. Whereupon we discover how he could have a chance at winning this. He’s requested a jury trial.

    A jury of uninformed individuals, who would possibly be open to all Thompson’s half-truths, outright lies, and libelious statements. Unless T2 does a significantly better job at highlighting all the holes in Thompson’s “proof” and “experts”, his case could possibly be seen as reasonable. If Thompson gets a good lawyer, and manages not to cut in with one of his rants, his case gets even better.

    I sincerely hope that it does not go to a jury trial. I would much prefer to see an informed judge, one who knows what is legal and what is not, cut through the arguments. One who will do background research upon being given evidence by either party, and notice the inconsistencies.     and even though i’ve been out of the loop for a bit my opinion on this whole “anti game” crap is BullS*** its pointless and there is no reason for it when we have more serious issues to figure out then making sure Video games like manhunt 2 and gta arent in the hands of “children” in which maybe if some damn parents went and did there jobs as parents then we wouldnt have to deal with this crap. Given i dont have kids or a wife for that matter but it just seems commen sense to me But it seems now that parents have this idea that it is wrong to tell your children “no”

    This is Jack’s swan song. This will go straight to the Florida bar, and I can’t conceive of him even working as a law clerk after this. No doubt we’ll see him initiating court cases and talking to politicians for a long time to come, and in fact he can probably represent his cause pro se, but he won’t be joining any more out of state cases.

    He’s already a failure in politics (due to the same paranoia and lack of tact), so he’ll probably just join up with some other far-right conservative group that will keep him on as long as he doesn’t talk to anyone but their own members.

    I also read a rather amusing comment on Gamespot’s coverage of it – JT in one paragraph condemns GTA for its preservation of bad racial stereotypes, and in another paragraph remarks on the “Scottish sociopaths sipping their single malt Glenlivet in between brainstorming software programming sessions.” Something about insinuating that Scots sit around drinking whilst planning their next depraved act doesn’t scream ‘racially sensitive.’
    (If there is a God, and if said chief deity has a really cruel sense of humor, he’ll allow a Scottish judge to decide the case. Nothing would be funnier than watching JT explain his remarks regarding Scottish sociopaths to Judge McGregor.)
