In Countersuit, Thompson Claims Take Two at Center of Vast RICO Conspiracy

March 22, 2007 -
Last week GamePolitics broke the news that troubled game publisher Take Two Interactive had filed suit against anti-game activist Jack Thompson in Federal District Court in Florida.

Late yesterday, Thompson sent out e-mails containing a copy of his response to Take Two's suit as well as a counter claim which, among other things, alleges the Grand Theft Auto publisher is at the center of a vast conspiracy to deprive Thompson of his civil rights.

Referring to Take Two in the court filing as "thuggish pornographers," Thompson charges that the company violated federal RICO (Racketeer Influenced and Corrupt Organizations Act) statutes, commonly used to prosecute organized crime syndicates.

Among Thompson's claims:
Take-Two has, since July 2005, been at the center of an effort to violate Thompson’s civil and constitutional rights... In addition to... extortion (intimidation) of Thompson... Take-Two has committed other predicate RICO acts, including but not limited to fraud, distribution of obscene and/or sexual material harmful to minors...

Additionally... Take-Two, through its Blank Rome lawyers, sought in Alabama to tamper with a witness in a pending criminal case, according to that witness’ lawyer.

Neither the witness nor the lawyer are named in Thompson's filing. The Alabama reference would be to the Strickland vs. Sony case in which an 18-year-old GTA player killed two police officers and a police dispatcher. Thompson represents the families of the victims in a $600 million lawsuit against Take Two, Rockstar, Sony, Wal-Mart and GameStop. The judge in that case, however, revoked Thompson's pro hac vice (visiting) admission to the Alabama Bar in November, 2005.

Later in the 37-page filing, Thompson adds perjury and obstruction of justice to his allegations against Take Two. He claims that Take Two has "collaborated and conspired with third parties to commit these racketeering activities." As alleged by Thompson, these "third parties" include many influential video game websites and publications, including this one as well as Kotaku, Joystiq, GameSpot, IGN, Penny Arcade, EGM, Game Informer and Spong.

Thompson also claims that game industry groups including the ESA and ESRB are involved as well as consumer group the Entertainment Consumer Association (ECA). The ECA is the parent company of GamePolitics.

GameSpot has more. Read Thompson's filing here (37-page pdf).

Come on everyone, we have to all band together and collect pop and beer cans, so that we may present Thompson with a tinfoil hat of suitable size, to protect him from all these crazy conspiracies!

I laughed when I first read this. I honestly thought Thompson had reached his low point but he never ceases to amaze me with his stupidity. How the hell did he even get a law degree?

Honestly why doesnt someone just hire a hitman to take this asshole out.

T2: Videogames also contain … original scores and songs.
JT: Denied.

Please. No one tell Nobuo Uematsu and Motoi Sakuraba.

Anyways, Jack Thompson... if video games DON'T have original songs, or artwork, or compelling storylines, then what DO they have?

I wonder how Jack would answer that question?

T2: Videogames also contain ... original scores and songs.
JT: Denied.

Last I checked, the London Philharmonic Orchestra only plays quality music and I have their Symphonic Suites for the first 6 Dragon Quest games.

Reading JT claim, you always find something else that strikes you as funny. Like his mention that a shaking car equates harmful sexual material to minors. Of course hes saying that "it's sex with a prostitute" but unless something more than a shaking car is shown, I doubt any court will find it harmful to minors. Otherwise, standards for ratings, both from the moive and videogames industries, will need to be completely changed. Imagine games and movies rated "Mature" for "sex hinted at".

man its getting to the point where you could almost label him as a paranoid schizophrenic.

Paranoia would be an understatement. Thompson needs to locked into the mental health place and the key thrown away.

To paraphrase the high school principal in "Billy Madison":

Mr. Thompson, what you've just filed in court is one of the most insanely idiotic things I have ever read. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this world is now dumber for having read it. I award you no points, and may God have mercy on your soul.

Karma's completely catching up to the Metropolitian Moron of Miami who couldn't just practice what he preaches about growing up and getting a life.

Wow, I can just picture Blank Rome drinking their coffee then spitting it out from laughter. I'd be surprised if they can hold their **** together whilst reading this.

This is going to be the longest drum roll in history until JT gets smacked with a dose of reality.
It is very dangerous to reject reality, as it typically has dire consequences for refusing to accept it.

It seems he has finally lost it.... wait did he ever have it to begin with?

A huge conspiracy theory that everyone is out to impede on his rights?

Wow I thought we had seen everything this man could come up with, but to try and use the RICO which is used to prosecute organized crime against a game company? Now that is just bat-**** crazy.

I hope he loses this suit and loses his license to practice law.

I'll admit, I couldn't force myself to read the whole thing, I felt dumber with each line, but I can say this:

Thompson, your god sends liars to burn in hell.

"Hold on, is Thompson actually claiming that Take Two is a game developing company AND a criminal organization (or at least a major part of one) in the freakin’ blue (as in, he’s flat-out admitting it, no hinting whatever)?"

Where Take Two is concerned, videogame company and criminal organization is pretty much the same thing to Jack Thompson. They're a criminal organization because they make mature videogames.

Now, I so want to do that. If only I could afford it...

This man isn't just crazy, he's #$^#$ING psycho. If I as the florida bar, I'd be appaled to think this so called "man" was licensed under my authroity to practice law. IT's time to put him out of bussiness, heres hoping the ESA and Take Two can get it done.

The link was fixed. try it again...

Don't forget the Kennedy assassination, faked the moon landing, constructed the pyramids, arranged 9/11, killed and buried Jimmy Hoffa (just look at GTAIII), legalized AND repealed prohibition, behind the Lincoln assassination, caused Janet's wardrobe malfunction, paid Britney to shave her head, covered up Roswell/Area 51, and is *gasp* promoting homosexual pornography in Bully.

This was his secret tactic? Really? I thought he'd have something half-way decent, but this? Mine as well have named the Knights Templar as a defendant.

Oh, and as a side note, I'm listening to "We Do" from the Stonecutters episode on the Simpsons. Sounds like Take Two could fit in the song perfectly in place of We Do.

I'm going to read this before I offer a "proper" opinion, but my first reaction to the highlights above is acute disbelief.

It's hard to tell whether JBT actually thinks this is a reasonable series of accusations to make, or whether he's just trying to be as outlandish as possible in order to draw attention to what he sees as T2's shaky legal ground.

Either way, it's a pretty ambitious list of claims and it'll be interesting to see how Blank Rome (and any judge(s) called to hear this nonsense) react.

This guy is the definition of paranoid, idiot, and f**kface. Seriously. What proof does he have that such reputal sites like Joystiq and Penny Arcade, which own a charity, all conspire against him. While it is true that 99.999999% of gamers hate Thompson with a passion, I think he just made it 101% of gamers, 70% of Gaming Indutries, and 60% of the Florida Bar

Any chance of you having to be involved, since you are named (ss I hope not, but it would strike me as a JT move. I can understand if you can't comment on that.

First reaction: Laughter. The bigger the conspiracy, the more believeable, right? This goes all the way o the top, right? I bet Dick Cheney is really behind all this, curse his evil body! (OK I'm joking)

My real initial reaction is: 37 Pages? TLDR.

But I will slog through it over my lunch hour, unless I can get caught up at work beforehand (not bloody likely, but now I'm doubly motivated).

~~All Knowledge is Worth Having~~

The link to the document won't work. Does anybody have a better one?

i hope i use the quote properly "I hope they throw the book at him" "him" being thompson

Is there no limit to this man's arrogance and stupidity? HE claims THEY are trying to intimidate him? And now he's claiming that they're an organized crime group trying to deprive him of his constitutional rights to harrass people, interfere with a legit company's business, and be generally irritating? I really hope they shut this man down, he's an effing loonie.

I've got nothing.....this guys is a joke. Hopefully "when" his suit is throw the FL bar will shortly do the same with his licence to practice law.

The medical term for this behaviour would be paranoid schizophrenia would'nt it?

And someone like this can still practice law?
Man I hope this little gem is also going to be used in the Florida bar examinations.
---- I'm not crazy, just ask the pink elephant...

37 pages eh? Wonder if he whipped that up over night, or if he had it ready in a box under his bed...

I can't even comment on this one... I just have no idea where to start.

The man has snapped. Even by his own standards... he's gone totally bat****.

Now, on top of every other conspiracy T2 is responsible for, there's also one against HIM personally. Oh dear lord, this is going to end in tears.

The life of Jack Thompson should be turned into a reality show. I can just see it now.

8:42a.m. - "The Morning Paper"

This morning upon making his cup of coffee and going out on the front porch to retrieve the morning paper, Mr. Thompson was hit in the face with it by accident from the local paperboy. Now it's time for you to vote America! What do you think Whacko Jacko will do? ---

a.) Shrug it off, no big deal

b.) Rant and rave

c.) Sue the creator and publisher of the game "Paperboy" for planting violent thoughts into the youth of those who deliver the daily news

If you picked "C", you are correct!

*side note*

Seriously though, the guy is just crazy. He either needs to be locked up or shot. I vote for the latter, cuz then the taxpayer's money wouldn't have to go to feeding him inside jail.

@ Griffin Lancer

I beat you to it by about a day.

From further up:

To paraphrase the high school principal in “Billy Madison”:

Mr. Thompson, what you’ve just filed in court is one of the most insanely idiotic things I have ever read. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this world is now dumber for having read it. I award you no points, and may God have mercy on your soul.

Jack Thompson is like Tinkerbell, but with lawsuits. Every time you clap with Peter, Tinkerbell gets a little better. Every time Jack Thompson files a lawsuit, he goes a little crazier.

At this point, I honestly just laugh. I mean, I saw this piece of news, and I literally just lost it laughing at work (got some funny looks, too. Oops.). When I got home and read through some of the filing, I lost it again. I'm convinced that Jack Thompson is really just a comedian impersonating a lawyer, because I don't see how he could be so unintentionally funny.

Can someone send JT a DS bundled with a copy of Brain Age? I think he's in some dire need.

Wait, scratch that. He'd probably sue Nintendo over subliminal, pornographic messages beamed down from the alien mothership over Pictochat.

Actually, the Stonecutters song is even funnier if you substitute "Take Two" for "We do".

As for Quixotic, it's certainly apropos ... except he has no Sancho to reform or Dulcinea to woo, nor a shred of nobility or chivalry behind his madness.

He can't even "win" the sobriquet of "most vilified culture war firebrand". Currently most would assign that to Fred Phelps. Jack is merely a more scatterbrained and slapdash Phelps, writ small.

Mr. Thompson, what you've just said is one of the most insanely idiotic things I have ever heard. At no point in your rambling, incoherent response were you even close to anything that could be considered a rational thought. Everyone in this room is now dumber for having listened to it. I award you no points, and may God have mercy on your soul.

That would work. For any occasion.

@Gabriel Celesta

You are indeed right. There's only one big difference between Mr. Crocker and our "special friend": Mr. Crocker is at least right in his ramblings. Jack's ramblings, however, are rendered illegible and just plain wrong by the crazy in his brain.

Well you cant willfully misrepresent the facts more than saying there is "homosexual sex" in Bully when it's only kissing.

Unless of course he really equates kissing to sex. Then it shouldnt be a surprise to anyone that some people take it upon themselves to send his wife sex aid products.

Joe Bourrie,

I agree. Thompson knows what the survey really says. At least he knew at one time.

“The FTC found that close to 40% of the time retailers are still selling mature-rated games to minors.” – Thompson 4/25/06

Maybe he forgot? Nah, I’m sure that as per usual, he’s just willfully misrepresenting the facts to further his own agenda. Nothing new there.

Andrew Eisen

"Of course, predictably, he’s misreading it. It says that during a 2005 survey of 406 stores, 42% of the attempts of a minor to purchase a Mature game were successful."

I doubt he's misreading it. It's a deliberate attempt to mislead, and if somebody calls him on it THEN he can say "oh, I must have misread it".

He may be a jackass but he's definitely not stupid. Every word that comes out of his mouth is intentionally misleading. Theres nothing worse than a compulsive liar with an agenda.

People keep saying that if he were taken out in one way or anothe; be it disbarrment or what have you, that this would somehow make him a martyr. I need to ask, a martyr for WHAT?!

Most people who martyr themselves do it with the assumption that someone else will be inspired enough to take up their cause in their place, picking up where they left off. Somehow, I don't see that happening with JT.

It's clear by now that no one likes him. Whatever allies he once had have been alienated by his behavior. What little he has left, like the Peaceoholics or the Eagle Forum, are fringe groups which hold very little influence. He's made many enemies in the judicial system, his fellow lawyers regard him either as a joke or an embarassment, he's burned bridges with several politicians (depsite his statements to the contrary) and even the press is starting to get tired of his antics as word spreads of how crazy and unprofessional he is.

If he going to be a martyr, he'll be a very lonely one, and I don't see many who would be eager to replace him, much less be as shrill or as crazy as he is. The only one I can think of off the top of my head would be Dave Grossman, but he's pretty much dropped out of sight and doesn't seem eager to come back.

As games continue to become more accepted as mainstream enterainment, become more ubiquitous and more politicians are sarting to come around to the fact that they may not be so harmful after all, JT's point of view becomes less and less relevant. If anything he's becoming percieved more like Don Quixote; tilting at windmills he thinks are giants while everyone else comments about how crazy he is. If he were to be taken out tomorrow, I don't think many tears will be shed, and that most will say he had it coming. In fact, I can only see the dialogue improving if he were removed from it, as we would no longer have to put up with his lies and be distracted by his histrionics.

Most likely, he'll be a martyr only in his own mind. He'll see it as committing "revolutionary suicide protesting the conditions of an inhumane world." But it will ultimately be a worthless gesture.

@ Hackangel

"Those were point 15-16-17 in T2’s suit (

JT rarely responds to the 50 points of T2’s suit by more than “Admitted” or “Denied”.

We could go over it point by point but just denying #17 shows how out of touch he can be with normal public perception. "

Not just public perception. A SCOTUS ruling extended 1st Amendment protection to video games on the basis of just that, so not only is JT out-of-touch with reality (which is far more common in people than we like to admit), he doesn't know the rulings of a higher court which he plain out "Denied."

His entire filing is simple rhetoric. A simple kiss is equated to "Homosexual Sex." (BTW - as we learned from Bill Clinton - oral sex is not legally "sexual relations") He purports that there is "Oral and Anal Sex," in the Hot Coffee scenes, which is fully misleading because the scenes on the disc are both fully clothed and contain no anal sex. He uses anecdotes and quotes from literature instead of citing precedent. He tries to take the reader on an emotional journey, and this is risky because of it's slippery slope nature. If TTWO's lawyers can show only one or two points of his to be wrong, the reader (a judge) will then be ultimately skeptical from there on out. He is masterful at loaded language, but this has no place in a court filing. In fact, most judges I know would be secretly insulted by the lack of professionalism in the court that this filing spews.

Putting all the rhetoric issues aside, his case his little merit because he outright denies standing precedent with no reasoning to why this would be a vaild point.

Personally, I think JT knows his legal days are numbered, and so he wants to go out a martyr. I fully expect him to be held in contemt during this case, which he wants to add to his christian persecution complex.

Penny Arcade's story today:

Jack Thompson knows!

Ah, yes, Retard Jack could be a real-life Denzel Crocker. Don’t forget the “I’m not crazy” bit. Crocker says it, and I’m sure Thompson would say it too."

I don't see how I didn't realize this comparison before!

@jdecamp, Ed Orman

The way I see it; eye for an eye. Especially considering the specific "character" involved.

"You know what, i’d hate to be a judge drawing straws for that one. Because you know every judge that may even remotely have to take that case will want to rather play Russian Roulette than have to preside over it."

I guess it just makes things all the more interesting?

No, no...sueing him isn't the way to go, if you were to take activism. You need to do something else. It's like this; the courtroom is his territory. Sure, he doesn't necessarily hold as much strength as he thinks, but instead, you want to get at him in a way more of us are much more familiar with than he is, basically, you got to use our territory, and the real world outside of the courtroom where, in the end, you hold higher power. For example, if you were to start a rally, y'know, outside, he really couldn't do anything about it I don't think, and can make all the threats he wants. And that's why you want people to gather as much information and records as possible, and should he by some chance appear in person, have video cameras to just in case, and use the gathered information to demostrate his attitude in full light. Basically, a public protest or the likes would be better than dragging lawsuits into it.

Jer: Take Two distributed Oblivion, which is where JT is making the link.

@Jer about the Oblivion thing.

Bethesda is the developer and owns the IP rights, but theyh didn't self-publish or anything. It was puiblished by 2K Games, which is a subsidiary of Take-Two.

(Thompson has repeatedly offered to Take-Two to cease all future efforts
against this company if it would simply instruct retailers not to sell its “Mature” products)

I think some one should email Mr Thompson and tell him that take two does not sell the games them selfs.

Ummm...does anyone else find it fascinating that Jack holds Take Two responsible for Oblivion....a game developed and owned entirely by Bethesda Softworks, which is a subsidiary of ZeniMax Media Inc.? Obviously I'm no smart lawyer, but I fail to see relevance.

^Theres another Jer here???

T2 should come here, to this thread, for easy and free refutation of JTs claims. I'm sure that we, the gaming public, can easily put the lie to pretty much all of JTs claims, WITH backup.

Methinks this will go very, very badly for Jacko. I'm gonna laugh my balls off the day he loses.

Just to make the lawsuit complete he should add Al-Queda, Iran and North Korea to it.
