In Countersuit, Thompson Claims Take Two at Center of Vast RICO Conspiracy

Last week GamePolitics broke the news that troubled game publisher Take Two Interactive had filed suit against anti-game activist Jack Thompson in Federal District Court in Florida.

Late yesterday, Thompson sent out e-mails containing a copy of his response to Take Two's suit as well as a counter claim which, among other things, alleges the Grand Theft Auto publisher is at the center of a vast conspiracy to deprive Thompson of his civil rights.

Referring to Take Two in the court filing as "thuggish pornographers," Thompson charges that the company violated federal RICO (Racketeer Influenced and Corrupt Organizations Act) statutes, commonly used to prosecute organized crime syndicates.

Among Thompson's claims:
Take-Two has, since July 2005, been at the center of an effort to violate Thompson’s civil and constitutional rights... In addition to... extortion (intimidation) of Thompson... Take-Two has committed other predicate RICO acts, including but not limited to fraud, distribution of obscene and/or sexual material harmful to minors...

Additionally... Take-Two, through its Blank Rome lawyers, sought in Alabama to tamper with a witness in a pending criminal case, according to that witness’ lawyer.

Neither the witness nor the lawyer are named in Thompson's filing. The Alabama reference would be to the Strickland vs. Sony case in which an 18-year-old GTA player killed two police officers and a police dispatcher. Thompson represents the families of the victims in a $600 million lawsuit against Take Two, Rockstar, Sony, Wal-Mart and GameStop. The judge in that case, however, revoked Thompson's pro hac vice (visiting) admission to the Alabama Bar in November, 2005.

Later in the 37-page filing, Thompson adds perjury and obstruction of justice to his allegations against Take Two. He claims that Take Two has "collaborated and conspired with third parties to commit these racketeering activities." As alleged by Thompson, these "third parties" include many influential video game websites and publications, including this one as well as Kotaku, Joystiq, GameSpot, IGN, Penny Arcade, EGM, Game Informer and Spong.

Thompson also claims that game industry groups including the ESA and ESRB are involved as well as consumer group the Entertainment Consumer Association (ECA). The ECA is the parent company of GamePolitics.

I laughed when I first read this. I honestly thought Thompson had reached his low point but he never ceases to amaze me with his stupidity. How the hell did he even get a law degree?

Last I checked, the London Philharmonic Orchestra only plays quality music and I have their Symphonic Suites for the first 6 Dragon Quest games.

Reading JT claim, you always find something else that strikes you as funny. Like his mention that a shaking car equates harmful sexual material to minors. Of course hes saying that "it's sex with a prostitute" but unless something more than a shaking car is shown, I doubt any court will find it harmful to minors. Otherwise, standards for ratings, both from the moive and videogames industries, will need to be completely changed. Imagine games and movies rated "Mature" for "sex hinted at".

I'm going to read this before I offer a "proper" opinion, but my first reaction to the highlights above is acute disbelief.

It's hard to tell whether JBT actually thinks this is a reasonable series of accusations to make, or whether he's just trying to be as outlandish as possible in order to draw attention to what he sees as T2's shaky legal ground.

Either way, it's a pretty ambitious list of claims and it'll be interesting to see how Blank Rome (and any judge(s) called to hear this nonsense) react.

Jack Thompson is like Tinkerbell, but with lawsuits. Every time you clap with Peter, Tinkerbell gets a little better. Every time Jack Thompson files a lawsuit, he goes a little crazier.

At this point, I honestly just laugh. I mean, I saw this piece of news, and I literally just lost it laughing at work (got some funny looks, too. Oops.). When I got home and read through some of the filing, I lost it again. I doubt he's misreading it. It's a deliberate attempt to mislead, and if somebody calls him on it THEN he can say "oh, I must have misread it".

He may be a jackass but he's definitely not stupid. Every word that comes out of his mouth is intentionally misleading. Theres nothing worse than a compulsive liar with an agenda.

People keep saying that if he were taken out in one way or anothe; be it disbarrment or what have you, that this would somehow make him a martyr. I need to ask, a martyr for WHAT?!

Most people who martyr themselves do it with the assumption that someone else will be inspired enough to take up their cause in their place, picking up where they left off. Somehow, I don't see that happening with JT.

It's clear by now that no one likes him. Whatever allies he once had have been alienated by his behavior. What little he has left, like the Peaceoholics or the Eagle Forum, are fringe groups which hold very little influence. He's made many enemies in the judicial system, his fellow lawyers regard him either as a joke or an embarassment, he's burned bridges with several politicians (depsite his statements to the contrary) and even the press is starting to get tired of his antics as word spreads of how crazy and unprofessional he is.

If he going to be a martyr, he'll be a very lonely one, and I don't see many who would be eager to replace him, much less be as shrill or as crazy as he is. The only one I can think of off the top of my head would be Dave Grossman, but he's pretty much dropped out of sight and doesn't seem eager to come back.

As games continue to become more accepted as mainstream enterainment, become more ubiquitous and more politicians are sarting to come around to the fact that they may not be so harmful after all, JT's point of view becomes less and less relevant. If anything he's becoming percieved more like Don Quixote; tilting at windmills he thinks are giants while everyone else comments about how crazy he is. If he were to be taken out tomorrow, I don't think many tears will be shed, and that most will say he had it coming. In fact, I can only see the dialogue improving if he were removed from it, as we would no longer have to put up with his lies and be distracted by his histrionics.

Most likely, he'll be a martyr only in his own mind. He'll see it as committing "revolutionary suicide protesting the conditions of an inhumane world." But it will ultimately be a worthless gesture.

Not just public perception. A SCOTUS ruling extended 1st Amendment protection to video games on the basis of just that, so not only is JT out-of-touch with reality (which is far more common in people than we like to admit), he doesn't know the rulings of a higher court which he plain out "Denied."

His entire filing is simple rhetoric. A simple kiss is equated to "Homosexual Sex." (BTW - as we learned from Bill Clinton - oral sex is not legally "sexual relations") He purports that there is "Oral and Anal Sex," in the Hot Coffee scenes, which is fully misleading because the scenes on the disc are both fully clothed and contain no anal sex. He uses anecdotes and quotes from literature instead of citing precedent. He tries to take the reader on an emotional journey, and this is risky because of it's slippery slope nature. If TTWO's lawyers can show only one or two points of his to be wrong, the reader (a judge) will then be ultimately skeptical from there on out. He is masterful at loaded language, but this has no place in a court filing. In fact, most judges I know would be secretly insulted by the lack of professionalism in the court that this filing spews.

Putting all the rhetoric issues aside, his case his little merit because he outright denies standing precedent with no reasoning to why this would be a vaild point.

Personally, I think JT knows his legal days are numbered, and so he wants to go out a martyr. I fully expect him to be held in contemt during this case, which he wants to add to his christian persecution complex.

No, no...sueing him isn't the way to go, if you were to take activism. You need to do something else. It's like this; the courtroom is his territory. Sure, he doesn't necessarily hold as much strength as he thinks, but instead, you want to get at him in a way more of us are much more familiar with than he is, basically, you got to use our territory, and the real world outside of the courtroom where, in the end, you hold higher power. For example, if you were to start a rally, y'know, outside, he really couldn't do anything about it I don't think, and can make all the threats he wants. And that's why you want people to gather as much information and records as possible, and should he by some chance appear in person, have video cameras to just in case, and use the gathered information to demostrate his attitude in full light. Basically, a public protest or the likes would be better than dragging lawsuits into it.

Bethesda is the developer and owns the IP rights, but theyh didn't self-publish or anything. It was puiblished by 2K Games, which is a subsidiary of Take-Two.

I think some one should email Mr Thompson and tell him that take two does not sell the games them selfs.
