Motion Denied... Judge Won't Allow Jack Thompson to Reinstate Kotaku Suit

Last week GamePolitics broke the news that Federal District Court Judge Paul Huck had rejected controversial attorney Jack Thompson's suit against Gawker Media, parent company of popular game blog Kotaku.

Yesterday, Judge Huck refused to accept Thompson's request to reinstate Gawker as a defendant. The decision would appear to end Kotaku's involvement in the federal court case in which Thompson is also suing the Florida Bar and Florida Supreme Court.

In his ruling Judge Huck wrote:
Plaintiff may not, time and again, add more and more distinct and unrelated claims into a single lawsuit. This action will not serve as a repository for any and all real or perceived claims that Plaintiff has against various entities...

Although Plaintiff, in his motion, characterizes the actions of the Defendants as a "collaborated assault" against him, it is apparent that... Plaintiff's accusations against Gawker Media... are wholly separate from his claims against the remaining defendants.

Thompson could opt to pursue other legal avenues in the matter which stemmed from comments written by readers of Kotaku. Case law, however, would appear to be on Gawker's side.

the problem with mr thompson is that i doubt it will ever dawn on him that all these legal defeats are a sign that he is on the wrong side of the law and judicial precedent in all these actions he takes. rather he will see this as yet another example of judges in the pockets of video game companies or as a legal system that is biased against his outspoken conservative christian beliefs. put simply, this guy will never learn

I won't be surprised to see JT file a separate suit against Gawker.
I wonder how much reimbursement Gawker will get from Thompson after he looses that?
Every time this lying buffoon get's shot down it never fails to brighten my day.

From the Judge's comments in the article, it's clear that he believes Thompson is making things up ("real or perceived claims"). It is also apparent that he knows, as do we, how ridiculous his claims of a grand conspiracy are.

This is funny, instead of losing one lawsuit, Thompson will suffer the indignity of losing 2 :) I wonder if it will cost him more in the long run, having to pay out for 2?

Actually, that scorecard should be higher, but I've lost count of all the cases that Jack has lost and all the Jack penned laws that have been overturned. What are we at now? 18? more?
I bet that Jack Thompson has links to all video game news sites and checks them everyday to find a chance to sue someone for assault or something.
Someone needs to tell JT that Federal courts are no place to settle petty grudges. That is all this Gawker thing is. A grudge. He has no real case, he is simple crying because Kotaku ripped his Fox interview apart.

This is a man who freely admitted, in his book, to having failed the Florida Bar exam the first time. Nevermind the fact that he doesn't exhibit ANY sane aspects a lawyer might actually possess, but he doesn't seem to have any idea as to procedure.
Poor old Jack, he really does have a problem with people posting facts to disprove his fantasies.

It's funny how he claims that gamers live in a fantasy world, and yet his own world is filled with an over-arching conspiracy where gaming companies, Industry watchdogs and Consumer Watchdogs (Who, in all industries get along like cats in a bag) are all in cahoots purely to target a lawyer who's total success rate against video games is....zero.

I'd say the person out there living in the biggest fantasy world of them all is Jack Thompson.
A lot of lawyers fail the bar exam the first time. It's not that unusual.

Most lawyers fail the Bar exam the first time. It's a tough test, and failing it isn't uncommon enough to be used as a barometer as who's going to be a good or bad (or successful) lawyer.
Given how bad of a lawyer he is, my bet would be that he cheated the second time he took the bar.

Did anyone else picture Nelson Muntz running to Jack and saying "Haw Haw"? Or was that just me? Up until the T2 settlement, I was beginning to think that Jack was a publicity stunt, but it's now apparent that he suffers from condition which causes him to disconnect from reality.
Oh man I love it. I mean, I know on some level we all agree with what the man says. Well, to the extent that violent games shouldn't go to minors without parental consent.

I'd almost like to send him a link to the work I'm doing with video games and kids, just so he'll see some positive video gaming, but I doubt it'd do anyone any good. He'd say it is horrible and we're horrible people, blah blah blah. Actually, I wouldn't be at all surprised if he tried to get us shut down, using claims that could NEVER beat our documented scientific proof of the good we've done so far.

You know, this guy has already gotten old. (I said this at least 2 years ago) Is there no one that will stand up and take him down once and for all? I mean, I would but he has never gone after me before. I would start a class action law suit for slander and libel against gamers but i don't know who would be on board for that one.

I doubt a class-action on behalf of gamers would hold much water. It is a group defined by a pastime, and not a more tangible thread. JT also has the right to say whatever he wants (though he believes himself to be the only person who has these rights).

I am just amazed at how much this guy yearns to be in the spotlight.
So how long before he tries to sue Judge Huck?
All the judge said was that he cannot include Gawker as a defendant as the case appears to be separate than that of his suit against the Florida Bar. It means that JT will undoubtedly file a separate suit against Gawker and Kotaku.

Sounds like Jack took the Bar exam like a lot poeple take their drivers test. It's so easy to fail a drivers test, especially if you got a strict judge. A lot poeple will practise hard for the test and follow every rule to the letter; stay below the speed limit, a nice stop at a stop sign and so forth. And yet, the moment they get their license they drive like they casually do, even if it's not how their supposed to drive...

Jack studied hard to pass the 2nd time, obeying every rule to the letter, but the moment he got his licence he forgot everything and became the arogrant, delusional, paranoid, conspriacy nut we know and loath today... guss he forgot that rules on the exam and everything they teach in law school were things a lawer was supposed to keep following throughout his career; not just stuff you should memorize to pass the next test

Basically, the judge wasn't buying Jack's claim Kotaku is conspiring with the bar to harass him. He seems to think Jack is makign up his claims against Kotaku, but he can't stop him from filing a separate suit.

Nevermind the fact that his wife passed the first time. While they were married. Apparently, her study habits didn't rub off on him.
for the record his lawsuit against the florida bar and florida supreme court (claiming apperently religious discrimination is still going forward) but htis is actually a good thing. see now the bar will have to take notice of how insane this man is. (as usual i blame any and all grammer and spelling errors on my computer =p)
Once again, a judge's ruling makes no bones about the conduct and the lack of accordance with the law from Jack. How many more before the Florida Bar step in? Or are they waiting for the all clear after winning this case?

Umm, I guess I'm just new and don't really know what the heck I did that ended up with that pingback comment. Didn't really mean for that to spam this page here, just wanted to give my audience some good PC/Console Gaming news.
