The respected San Jose Mercury-News is the de facto paper of record in California's high-tech Silicon Valley. And newspaper people are generally quite supportive of First Amendment issues.So it may be surprising to learn that an editorial in today's edition applauds Gov. Arnold Schwarzenegger's appeal of a recent federal court ruling which declared the state's 2005 video game law unconstitutional. From the editorial:
Given the nationwide track record [of game laws being declared unconstitutional, the appeal] may be a waste of time. But maybe the ninth time's a charm. We hope so. It shouldn't be so hard to protect children from the most twisted, sadistic images that the mind can imagine...
[California's] law was never intended to replace parents' judgment.... But [U.S. District Court Judge Ronald Whyte] said that the law was too broad... And he said that the state failed to cite persuasive evidence that playing violent videos causes anti-social, violent behavior among children...
But Whyte, like other judges, has demanded too high a burden of proof. When it comes to indecent material, courts have given regulators and legislators wide discretion to protect children... Judges haven't applied the same common-sense standard to extremely violent video games...
Schwarzenegger, in his prior career as action actor, committed his share of tasteless violence. Consider his defense of video game limits an act of penance...

As GamePolitics reported back on May 3rd, 2005 - months before the California video game law had even passed in the legislature - the paper likened game violence to pornography and described then-Assemblyman Leland Yee's bill as a sensible approach to the issue.

I am curious about which games the author consideres the "most twisted, sadistic images that the mind can imagine". I can't think of anything in games nearly as gross as in most horror flicks.

This line says a lot to me. The writer of said article obviously has a problem with violent media. Never mind the fact that violence has been around in media for centuries, if not longer (Shakespeare anyone?). No, this person only cares about what they think these things do to people. After all, they are smarter than us. The newspaper said so.

The SJM editorial is completely inane.
Penance? Give me a f***ing break! Any objective observer would see the Governator's campaign as nothing but pandering given the Constitutional issues. I don't know why that editorial was written, but I suspect it is either because the editor is friends with the Governator, or wants something from him.
I don't think I need to remind you about probability. It is much more probable that religious idiots on the right will support freedom-raping forms of censorship.
And yes, it's a real shame that some on the left feel as if they must cater to the superstitious members of their constituancies by taking stronge stances in the name of "teh children."

Clearly the only solution is to give every child a lobotomy at birth. That is the only way that they won't be able to think any more.
The burden of proof has to be high, since Arnold is directly contradicting a Constitutional Amendment.

So why are morons like Leland Yee making laws that are abridging the freedom of speech?
Sure, they try to use the old “you can’t yell ‘FIRE!’ in a crowded theater” rule(an example always given of how freedom of speech is not absolute), that you can’t use your speech to put others in harm’s way.
However, if you’re going to infringe on a constitutional right like freedom of speech based on the idea that the speech you’re trying to ban is dangerous, then you better damn well show the people absolute proof that the speech in question(in this case, “violent” video games) is dangerous. This has NEVER been done. There is no proof that any harm will come of anyone who plays a “violent” video game.
If there is a danger so clear and so threatening to the American people that causes the above dumbbells like Yee to step on the First Amendment, wouldn’t any rational thinking person have to believe that the danger would have to be so obvious and clear that there would be no argument against it? You’re directly contradicting a Constitutional amendment.
We, the American people, have not been given any valid reason to believe that this abridging of our freedom of speech is necessary. There just simply isn’t any evidence at all of any danger from “violent” video games. This “protection” from “violent” video games isn’t needed, but please feel free to use my tax dollars for protection from things like 10-foot hurricane storm surge entering the workplace.
Oh, and it's not an act of penance, more like an act of hypocrisy, since he's also made money on his likeness being used for games based on the Terminator movies, and True Lies, and Total Recall.

The majority of these bills are from left-leaning Democrats. The Nanny-State is more of a leftist ideal. Censorship is the end result of Nanny-State Socialism and Religious Fundamentalism. Put things into perspective and dump the agenda.
The fact that the paper called them "videos" is proof-positive of their cluelessness on the actual topic.
It's more like the post-moral majority religious right and evangelicals have grappled such an influence over Washington that those on the left feel that rallying "behind teh childrenz" has become the only way to gain support among superstitious voters (35-40 million).
And to prove my point, I pose the question, where do the value systems and "morality" that these individuals claim to possess (and enforce 'for teh childrenz') come from? Who are the major proponents of this value system? What group of people has historically suppressed ALL forms of freedom WITH the "values" of this value system? What political leaning is FUNDAMENTALLY tied into the preservation, propogation, and indoctrination of these "values?"

So Yee is planning on enforcing the MPAA ratings through this legislation then? How about the TV ratings. Maybe we should look at books too. Nothing stopping a child from going into a book store and picking up some murder porn lit.
I've played a wide variety of M rated games and I have to say that I've seen much worse in cinema. Read worse in literature.
If they were really concerned about "the children" then they'd stop scape-goating and go after ALL violent media. Until then, they are just grandstanding.

Actually no, they haven't been given as wide a berth as the SJ Merc may think. Or has the SJ Merc staff not seen many "teen" (PG-13) movies lately?
And actually, I've never agreed with the ban on indecent material either. There's no consistency, and when your in the grey zone you're either an artist or a criminal.

The fact that folks of this guys ilk ignore facts that are widely available, publicised on this very site, just goes to show that they don't want facts - they just want their beliefs. And one of those beliefs is that we, as gamers, are the greatest threat in the world.
