Florida Supreme Court Sanctions Jack Thompson
The Florida Supreme Court will no longer accept anything directly from controversial Miami attorney Jack Thompson. If Thompson wants to file with the Court, he’s going to need to hire another lawyer to do it on his behalf.
That’s the ruling handed down by the Court late this morning.
As GamePolitics reported last month, the Florida Supreme Court issued a show cause order demanding that Thompson explain why the sanction shouldn’t be issued. Clearly, Thompson’s multiple responses did nothing to change the collective mind of the Justices.
The order issued by the Court may be found here, and the following passages are quoted from it:
After submitting inappropriate and pornographic materials to this Court, Thompson was specifically warned that should he continue to submit inappropriate filings, this Court would consider imposing a sanction limiting Thompson’s ability to submit further filings…
Since that order, Thompson has filed numerous additional filings which led this Court to issue an order directing Thompson to show cause why we should not limit his filings… We now sanction Thompson…
Thompson engaged, to the point of abuse… in a relentless and frivolous pursuit for vindication of his claim that he is being victimized by The Florida Bar…
Thompson’s multiple responses are rambling, argumentative, and contemptuous… What we cannot tolerate, however, is Thompson’s continued inability to maintain a minimum standard of decorum and respect for the judicial system to which all litigants, and especially attorneys, must adhere…
A thorough review of Thompson’s filings lead to one conclusion. He has abused the processes of the Court… Accordingly… the Clerk of this Court is hereby instructed to reject for filing any future pleadings, petitions, motions, documents, or other filings submitted by John Bruce Thompson, unless signed by a member in good standing of The Florida Bar other than himself.
…Further, if Thompson submits a filing in violation of this order, he may be subjected to contempt proceedings or other appropriate sanctions.
For his part, Thompson has sent out an e-mail describing the Supreme Court’s order as both “good news” and “idiotic.”
GP: Just to be clear, this sanction imposed by the Florida Supreme Court is a separate issue from Thompson’s Bar Trial which we have been reporting on in a series of articles this week. No decision has been rendered by the referee in the Bar Trial as of yet.
UPDATE: Thompson writes in to say that he mailed today’s motion prior to the Florida Supreme Court’s order and that, in any event, he is entitled to make an oral argument on the matter.

Even presuming the worst and there is no disbarment, this is devastating to his career as a lawyer.
How can he represent people in Florida when any case could potentially go before the Supreme Court of the state, and he’d have to bow out and get another lawyer?

the funny thing is this could hae been easily avoided by him, the reason he got sanctioned is not for the fact that his filing are asinine but for the reason that he sends 14 when 1 will do the trick, for example, he is given 14 days to show cause, and he sends them files on days 2,4,5,7,8,10, and 13, had he instead held off on filing until day 13 or 14, and filed them all as one huge file (not so huge as most of the filing all state the same thing) this wouldn’t have happened to him he has nobody to blame for this but himself

This story has made my day just a little bit brighter. We all know Jack will not go down quietly, even with the sanctions against him. He will continue to submit filing after filing until he is held in contempt. He will then scream his First Amendment Rights are being violated.

This is great news. Not the best news (that of his disbarment), but good all the same. Now that they have told him in plain language why his filings were intolerable, maybe he will have the time to reflect on them and realise what an idiot he has been. In all seriousness, how could a grown man think that petty insults, accusations of conspiracy, pornographic material and the infamous “picture book for adults” were good ideas?
I think most, if not all people learn at some point in their lives that sometimes there are things that should not be said. Conversations where things said too hastily in anger or frustration cause the loss of friendship, respect, or even have repercussions on one’s professional life. Things we say that we wish we could take back and this time, think before saying. That’s in the spur of the moment however. This man rattled off his letters, “media alerts”, “responses”, motions, etc. without a single thought as to whether what he was saying was a good idea or not, and it has cost him dearly.
Abraham Lincoln was said to have wrote letters in anger. Mean, spiteful an insulting letters, but he never sent them. As he wrote, he mulled over his words and ultimately decided against sending them, perhaps instead, having “exorcised” the angry words and getting them out, he was able to reflect without the initial anger and compose more suitable messages. If only Jack had picked this historical figure to compare himself to (as opposed to Paul Revere, Jesus, Batman, Martin Luther King, etc.), he may not have ended up in his current pitiful state.

This is a victory for the Florida legal system, yes, but for JT it’s only an obstacle. Remember his wife is a lawyer, and while we know she’s sane and has good standing in the legal community, we don’t know if she’s also willing to throw it all away for him.
I doubt it because she’s got a long list of honors and is part of a good firm, but you never know.

I just finished reading the full order. The Tasse order is hillarious. Mr. Thompson has been extremely arrogant and derogatory, but I do not recall him ever dropping “Mother-F@#ker” in any of his filings. I was thinking of something else that was brought up in the Tasse filing.
Court orders and filings are part of public record, but public record cannot be used as a cause for slander/libel. So, uncouth individuals that happen to have a J.D. and practice in a particular state can file defamatory and potentially libel/ slanderous statements all day long and not get busted for it. I would argue that use of the courts in this manner is another violation of the Bar’s code of ethics, and also grounds for a contempt of court charge. Just a thought.

I wonder if this will cause him problems. While he knows other lawyers, I’m sure he is only on friendly terms with some of them. The court has already spoken out on this matter, so he will either need to stop sending them, or try and get someone to sign them for him. But that carries the danger that whoever signs for him will also face contempt charges unless they are reasonable filings. That would mean that just about anyone he approaches to sign it for him will likely turn him down. This could cause him to feel isolated or friendless.
What happens then depends on his reality distortion field. He will either feel as if everyone in the world is holding him dear in their heart, or he will possibly lash out at a world that has rejected him, likely in a long and rambling press release.
Note: I purposefully didn’t name any relations in this post.

I don’t think that it is so far fetched that he could find a lawyer to submit for him. For a price that is. I would certainly charge him to be his personnal editor. I charge by the word edited.
But yes it won’t be so hard. Some lawyers don’t care much about the case, just getting paid for it.
The hope here by the Court is that by getting a real lawyer to sign off on filings, it will dramatically reduce the volume and clean up the language of the filings.
This can only be a good thing.
I feel sorry for the poor court clerks who had to wade through his bile.

Two points I find interesting:
“In sanctioning Thompson, we are requiring him to retain qualified counsel so that his arguments might be properly presented through the appropriate procedures in the appropriate forum.”
This pretty much shows the court doesn’t feel he is a qualified counsel. If he is not qulaified, how can they keep him on the bar?
Now for the scary part:
“NOT FINAL UNTIL TIME EXPIRES TO FILE REHEARING MOTION, AND IF FILED, DETERMINED.”
That means, about 2:30 PM, you can expect him to file a Rehearing Motion, stating that he can file it because this sanction wasn’t finalized yet.
I do like how when he claimed they couldn’t forbid him access to the court system, they showed in almost a pages worth of cases where they, and the Supreme Court, have ahd to do this, showing that yes, they can restrict it, it isn’t preventing him from seeking justice, just requiring him to stop wasting their time.

Because it’s not up to the Florida Supreme Court. Disbarment is handled by the Bar, not the court. They are, however, allowed to be quoted as an “authority” when it comes to determining if he is qualified to be a lawyer.

He can file it. It’s a “final chance” to state his case. However, they are free to reject the motion (see the determined catch), which would finalize the order…

Jack obviously believes he’s going to make a case of conspiracy because of all these legal issues going against him. He is truly insane and lacks a true understanding of how to grasp reality. Truly ironic considering that’s what he charges we, the gaming community with.
With that in mind Jack will UNDOUBTEDLY file regardless of this motion. Simply because of the above. He will be hit with contempt and Jack will see this as another victory within his own little conspiracy argument.
Jack, I’m going to just break this to you… There is no conspiracy. You’re simply wrong. The super majority of the legal system has ruled everything you’ve come up with as wrong. All of the bills you tried to get into law and when they were made law were struck down by judges quoting the first ammendment of the United States Constitution.

Actually, in Jack’s (and all other) disciplinary proceedings, the Florida Bar prosecutes. Judge Tunis makes a recommendation in her Report. The Florida Supremes either accept or reject her recommendation and stamps their approval or disapproval. So, the binding sanction actually eminates from the Supremes.

I suppose. The disbarment is essentially the Bar suing JT for “breach of contract” (breach of the rules he agreed to abide to when he got his license).
So the judges do have authority to “rule in favour of” the plaintiff (the Bar)…

Plus he’d probably insist on Pro-Bono, seeing as how he hates handing out money (see the Junkin article about how JT thought a 10% cut for co-counsel was “outrageous”).
Best he might get is a law-student, working the Pro Bono track, at most they’d give him one chance before getting tired of his constant nagging and harassment…

I’m not saying that Jack won’t find an attorney to represent him before the Supremes. As EZK says, for the right price, that’s an easy do. What he’ll never find is an attorney stupid enough to rubber stamp the kind of pleadings he’s been filing with the Supremes. Because any attorney with half a brain will realize that do so will only land them in same kind of hot water that Jack’s in, and I can’t see a sane attorney wanting to do that at any price.

Basically, without the ’shock’ element, Jack loses the power to attract Media attention. One thing I would not be surprised to see is an increase in the ‘Media-grabbing’ content of his Bar-hearing filings, since he’s only got one place from which to perform his own somewhat unique type of attention grabbing.

Sounds like just the Florida Supreme Court, where his disbarment cases are currently in “review”.
So he could presumably still flood the lower courts, and he could still file federally (although he has insisted he will, the last time he did the court denied him and said to let the Florida court finish first…)
And he can’t file outside his jurisdiction without some other lawyer, or getting Pro Hac Vice (and I’m sure they wouldn’t grant it if he was in the middle of a disbarment hearing…)

I was thinking about Jack this morning, before I saw this. More specifically, I was thinking about his wife. I find myself wondering what kind of person she is. From the little I know, she’s a successful attorney, but I wonder about her personally. for instance, how involved is she in Jack’s Crusade? We never see or her from her, so I would suspect she’s busy with her own work. I wonder though, if she ever says, “Jack, you’re on the verge of disbarment. Stop and think for a minute about what you are doing.”
I have the good fortune to be married to a wonderful woman who is willing to support me, but who isn’t afraid to call me out when I’m wrong. I was thinking about her this morning, and about what kind of woman is married to Jack Thompson, and how this affects her life.
Maybe she doesn’t pay as much attention. Maybe she really believes in him and is pushing him on. Maybe she is telling him to stop, to try to save a sinking ship. Maybe he’s been trying to hide all this from her, which, while unlikely, screams sitcom to me. Like I said, I know she’s an attorney, and that’s about it. It was just a thought I had this morning.

Isn’t one of his smoke-screens that the Bar and Judge Tunis illegally stole his co-counsel’s medical records? He tried to argue that point on behalf of his co-counsel at his hearing and Judge Tunis had to remind that he was his co-counsel’s client, not his attorney.

I’m going to stick with the averages and keep to my zero with his wife in mind when it comes to filing.
She’s kept out of JT’s business throughout all of his shinanagans and I don’t see why that would change now. When you ask a wife to do something for you, she may smile and nod her head… but there is no such thing as ‘pro bono.’
But seriously, speculation about Jack’s family is nothing wrong, so long as we do not diss on her. I am frequently quite curious as to what her opinions are and how what her husband does by making himself such a public figure impacts her life.
It’s not like the public scrutiny has yielded any results. Jack is akin to a politician, albeit a rather poor or unrealistic one. And a politician’s family is under scrutiny almost as much.
Only thing I can really speculate is that it has not (yet) affected her career as a lawyer by association. Though I’m sure there are small sniggering groups at gatherings when she walks by, as they joke about JT.

The only reason I feel JT had this coming is he brought it on himself.
JT was a worthy advesary up to the point he just started insulting every gamer in the world. Having a difference of opinion and voicing it is admirable. I, myself, have best friends who sometimes I’d love to just CLOCK for what I feel is stupidity they spew, but at the end of the discussion we shake hands and know that we are colleagues and no one is right or wrong we simply have different views and things we hold dear.
Jack Thompson has brought this on himself. I, for one, have never wished ill will against him. Oh yeah he’s got my ire up, but he has a position and he’s sticking to it. Unfortunately that turned into a vendetta and now it’s become nothing more than a festering wound of hate for our favorite, game hating lawyer.
I hope he comes to his senses if not for his own sake, his family’s.

You raise an interesting point (although your prediction may not come true for the following reasons):
I suspect there’s a simple explanation (in part) for why Jack kept ignoring the Supremes’ instructions to stop filing papers with them and, instead, file his papers with Judge Tunis: the Supreme Court allows for electronic filing, while I’m not so sure the 11th Circuit does. If they don’t, then there’s your partial explanation: Jack didn’t want to either (a) drive down to the courthouse every time he wanted to file a paper (i.e., two, three times a day) or (b) pay a courier to do it for him. So he kept on clicking the “Send” button.
And if the 11th Circuit doesn’t have e-filing, then I wouldn’t look for an uptick in crazy filings with Judge Tunis because he still won’t want to do either (a) or (b).

@Repudiator — he was allowed to file a response up to a 2:30 eastern deadline. It was filled with his usual bluster and the “you can’t deny anyone their 6th Amendment access to the courts rights” bluster, which, if he’d read the sanction, he’d have seen they can. If you look, his response was “DENIED, SEE OPINION FILED 3/20/2008.” In other words, there was NOTHING in Jack’s filing that hadn’t already been covered in the SCOFLA sanction against him.

He actually did face a psychiatric evaluation previously several years ago. If I understand correctly, it was the same psychologist that he hired recently to perform another evaluation, Dr. Wunderman.
Of course, had I the legal Right to do so, I’d jump at the opportunity to move that there is a conflict of interest in the evaluation by Dr. Wunderman.
As I have ntoed before, while religion may be acceptable as a foundation for counseling in general (it should be a patient’s choice whether to be counseled by someone who mixes religion in with their counseling), an evaluator who shares similar or equal religious beliefs cannot be viewed as being unbiased when evaluating a patient for another organization or legal body.
It would be like having a psychologist who believes repeated shock therapy will “cure” homosexuality evaluate Fred Phelps or having a psychologist who is a member of the Black Panthers evaluate Al Sharpton or Jesse Jackson.
Dr. Wunderman and his wife (who is actually a religious leader in a church) actually share very similar fundamentalist religious beliefs with John Bruce. So, quite frankly, his evaluation cannot be viewed as unbiased.
