Florida Supreme Court Sanctions Jack Thompson

March 20, 2008 -
The Florida Supreme Court will no longer accept anything directly from controversial Miami attorney Jack Thompson. If Thompson wants to file with the Court, he's going to need to hire another lawyer to do it on his behalf.

That's the ruling handed down by the Court late this morning.

As GamePolitics reported last month, the Florida Supreme Court issued a show cause order demanding that Thompson explain why the sanction shouldn't be issued. Clearly, Thompson's multiple responses did nothing to change the collective mind of the Justices.

The order issued by the Court may be found here, and the following passages are quoted from it:
After submitting inappropriate and pornographic materials to this Court, Thompson was specifically warned that should he continue to submit inappropriate filings, this Court would consider imposing a sanction limiting Thompson’s ability to submit further filings...

Since that order, Thompson has filed numerous additional filings which led this Court to issue an order directing Thompson to show cause why we should not limit his filings... We now sanction Thompson...

Thompson engaged, to the point of abuse... in a relentless and frivolous pursuit for vindication of his claim that he is being victimized by The Florida Bar...

Thompson’s multiple responses are rambling, argumentative, and contemptuous... What we cannot tolerate, however, is Thompson’s continued inability to maintain a minimum standard of decorum and respect for the judicial system to which all litigants, and especially attorneys, must adhere...

A thorough review of Thompson's filings lead to one conclusion. He has abused the processes of the Court... Accordingly... the Clerk of this Court is hereby instructed to reject for filing any future pleadings, petitions, motions, documents, or other filings submitted by John Bruce Thompson, unless signed by a member in good standing of The Florida Bar other than himself.

...Further, if Thompson submits a filing in violation of this order, he may be subjected to contempt proceedings or other appropriate sanctions.

For his part, Thompson has sent out an e-mail describing the Supreme Court's order as both "good news" and "idiotic."

GP: Just to be clear, this sanction imposed by the Florida Supreme Court is a separate issue from Thompson's Bar Trial which we have been reporting on in a series of articles this week. No decision has been rendered by the referee in the Bar Trial as of yet.

UPDATE: Thompson writes in to say that he mailed today's motion prior to the Florida Supreme Court's order and that, in any event, he is entitled to make an oral argument on the matter.

Nintendo is indeed selling SOME of these on the Virtual Console but not even close to all of them. While i agree in part to his piracy he was filling a market that Nintendo failed to recognize. Maybe someone doesnt want to buy a Wii. maybe they just want a console with 50 - 100 NES games on them?? maybe just maybe?

If you have followed the Steamboat Willie case regarding Mickey Mouse you can rest in your bed well at night knowing that the MOUSE will still be under copyright law, away from public domain after your great grandchildren are in nursing homes. That is beyond ridiculous dont you think??

I'm guessing the next step is to sue the Florida Supreme Court, the Bar, Take Two, EA, Microsoft, GP, Kotaku, PA, Nintendo, Sony, Norm Kent, that guy who's always waiting for the bus who looks at him funny, Salvador Dali, and the Lone Ranger in federal court for conspiring against him.

Not unexpected at all.

Too bad it only applies to the Florida Supreme Court, and not any sub-courts... Oh well. It's a start. ;)

Because it's not up to the Florida Supreme Court. Disbarment is handled by the Bar, not the court. They are, however, allowed to be quoted as an "authority" when it comes to determining if he is qualified to be a lawyer.

"That means, about 2:30 PM, you can expect him to file a Rehearing Motion, stating that he can file it because this sanction wasn’t finalized yet."

He can file it. It's a "final chance" to state his case. However, they are free to reject the motion (see the determined catch), which would finalize the order...

Actually, in Jack's (and all other) disciplinary proceedings, the Florida Bar prosecutes. Judge Tunis makes a recommendation in her Report. The Florida Supremes either accept or reject her recommendation and stamps their approval or disapproval. So, the binding sanction actually eminates from the Supremes.

I suppose. The disbarment is essentially the Bar suing JT for "breach of contract" (breach of the rules he agreed to abide to when he got his license).

So the judges do have authority to "rule in favour of" the plaintiff (the Bar)...

Even presuming the worst and there is no disbarment, this is devastating to his career as a lawyer.

How can he represent people in Florida when any case could potentially go before the Supreme Court of the state, and he'd have to bow out and get another lawyer?

the funny thing is this could hae been easily avoided by him, the reason he got sanctioned is not for the fact that his filing are asinine but for the reason that he sends 14 when 1 will do the trick, for example, he is given 14 days to show cause, and he sends them files on days 2,4,5,7,8,10, and 13, had he instead held off on filing until day 13 or 14, and filed them all as one huge file (not so huge as most of the filing all state the same thing) this wouldn't have happened to him he has nobody to blame for this but himself

I cannot express how relieved I am to see some sanity demonstrated by our courts, and I feel vindicated in my belief that Thompson is just batshit crazy.

I almost want him to be unbanned. What can he possibly say now?

I also love how his answer was effectively "It would be easier for me to disbar everyone involved in this case than to justify myself" and "Telling me to only file sensible motions is the exact same thing as silencing me entirely!"

So, yeah, no surprise here really.

This story has made my day just a little bit brighter. We all know Jack will not go down quietly, even with the sanctions against him. He will continue to submit filing after filing until he is held in contempt. He will then scream his First Amendment Rights are being violated.
