California Sen. Leland Yee (D), the architect of his state's contested video game law, has weighed in on the upcoming Grand Theft Auto IV release.

Sen. Yee issued a press release this afternoon warning parents that the M-rated game is not meant for children:
It is imperative that parents avoid purchasing this game for their children and always review the video games their children are playing.

Unfortunately, the makers of Grand Theft Auto have a history of deceiving the ratings board and the public on the true content of their games.  Parents beware: this game undoubtedly glorifies violence, is extremely realistic and designed for adults only.

Yee cited the 2005 Hot Coffee scandal in his release as well as the Federal Trade Commission's most recent secret shopper data, which indicated that, nationally, underage buyers were successful in purchasing M-rated games 42% of the time.

What I wish people would stop doing is telling us how we should raise our kids. If they wish to inform the public about the rating system...then talk about that, for instance it should have been writen like this:

"Parents, I would like to take this time to inform you about the ESRB system we have in place for video games.

T-Teen
M-Mature - 17 years and older
With certain M rated video games being released such as GTA VI, be be sure to make your self knowlegable about what your children are viewing and playing. This is simple to do, all games have a rating symble in the lower corner of the case and on the back lists reasons why the game has been given the rating. Reasons such as alcohal, sexual themes and violence. The Mature ratings are equivilant to a Restricted rated movie. Now THAT is how the speech SHOULD have been delivered, but then that would be free of biasted opinions and over zealous incompitency. Effen politics...why is it that we keep electing dumb assess to govern us...
It is always funny to see how people like Yee and various parental groups tend to warn people about Take Two games only. How about them violent movies Yee? Of course, he will never say anything about them since he is getting paid for by movie industry. I am sorry, but there is no need for any of them to warn parents about Take Two games because parents should always pay attention to what their children consume. But hey, I bet Take Two will thank you for the free publicity.

However, I agree that the GTA games are NOT for children at all. That's what it was supposed to say. I do believe that - just like games like Manhunt 2, Bioshock and the Hitman games are not for children. At all.

While I appreciate Yee pointing out the fact that GTA is designed for adults, from the quote it seems to me he's almost trying to order parents not to buy it.

Parents should certainly review games to see if they're appropriate for children, but the idea that "GTA is inappropriate for all minors" is a sweeping generalization, and it leaves a bad taste in my mouth.

Yee waves around his degree as a child psychologist almost as much as JT waves his (hopefully soon to be late) license to practice law as some kind of sign that he knows what the fuck he's talking about.

The outright LIE that Take Two tries to deceive the ESRB to garner lower ratings is outright libel. Not only is it untrue, but there isn't a single iota of content legitimately included in the game worthy of an AO rating (since Hot Coffe needed a hack in order to be unlocked, I wouldn't include it as legitimate content). Not only have they tried to obfuscate AO content, they also haven't ever tried for any rating lower than M. I fail to see how they could "have a history of deceiving the ratings board" when every GTA game ever made has been given the most mature possible rating that would still allow it to be stocked by retailers.

Btw, does anyone know if Take Two was reprimanded by the ESRB in any way for the Hot Coffee scandal?

I'm not really suprised at this news. With this game coming out, I was expecting to hear announcements from Yee (as well as Walsh) like I count on the sun rising in the east. I'd be surprised if I didn't hear anything from them.

And to those who say Yee is as bad as JT, I disagree. Yee may be obstinate and has demonstrated a penchant for being bull-headed
in his statements, but he doesn't even come close to JT in his reckless disregard for the truth. Yee on the other hand strikes me as being simply misinformed and out of touch, which is par for the course really with most politicos on this issue.

If Yee really does take JT's place as Gaming's Public Enemy No. 1, I for one will be glad; at least we can expect him to be civil and to have a reasonable dialogue with him. I'll gladly take Yee over JT any day.
Actually, I don't really mind having video games' biggest enemy be Jack Thompson. As long as enemy number 1 is a raving senile lunatic, it makes the anti-gaming bunch that much harder to take seriously.

You take a guy like Yee who's more composed in his delivery and more likely to be taken seriously as a result, the anti-gaming bunch gains undeserved creditability.

Fortunately, Jack's going nowhere. Law license or no, he'll never stop fighting his crusade and making the anti-game movement look more foolish as a result.
Someone needs to cozy up to Lee and expose the truth about games to him. That is the only way he could truly open his eyes. Otherwise, It may be that he is truly corrupt and needs to be taken out of power.

2:Undoubtably glorifies violence? The game has plenty of violence, but to say it atempts to condone or encourage real life violence is undoubtably a stretch. A piece of entertainment can be about something without encouraging it. In fact, I don't recal playing any games that look at violence as a good thing or the only way to solve every problem. GTA portrays violence more as a nessasary thing, and it probably is the best way to fend of crazy ass drug lords and gangsters. I certainly wouldn't try offering them candy.

I completely agree. Lee may have statement similar to Thompson, but he's nowhere near as dense as him. And he can have a civil conversation, the statement (even if it's part untrue) is a proof of this (just compare it with Jack's recent TV appearance).

Only thing is...no one (as far as I know) tried to contact him (at least on a civil manner).

Seems like he kept quiet for quite a long time, though.

I know this has been said before, but dang! I read the first part and thought he was finally thinking. But then I read the other part and he makes it sound like it has a E for Everyone label.

The people at Rockstar aren't idiots, they knew what would happen if something like hot coffee were made. My guess is that it started as an office joke of "haha look what I made" that somehow ended up buried in the code of the actual game that they didn't know was still there when it shipped.

Lee is more intelligent and charismatic than Thompson, which makes him a more serious case to note. But it is twofold, since he is not as zealous about the topic, so he's not more "dangerous" than Thompson.

What we should be afraid of is if any public figure manages to attack video games without much basis of proof, but is very effective in getting his message across with a lot of charisma and eloquence.
/sigh... it was going well up until he called out R* on deceiving its customers, but for the most part it's decently executed. Does sound like he's telling parents how to raise there children, however it seems like too many parents need this.

@Grizzam: Hot Coffee *was* the developer / publisher's fault. It wasn't like people created the content and added it to the game. They unlocked it. The publishers whether on purpose or by accident, lied about the content.

to be completely fair Take Two has a very small history of ratings missteps

first there was the infamous hot coffee which was technically Rockstar's fault, however i still believe that the ESRB overreacted (mostly from T2 and R* claiming it was all the hackers fault)

and secondly there was the issue with 2k, Bethesda, and Oblivion, where the review tape apparently did not show the worst of the violence and gore, and as such originally received a T rating

Yes, T2 screwed it up hard with the Hot Coffee fiasco, But people like Yee still try to use fear and misinformation to accomplish his goals. He is still lying and talking about something he obviously doesn´t understand.

He still is trying to make believe to parents that videogames are just for little children and evil videogames companies are trying to corrupt "american youth".

If this prevents one parent from buying the game for their children, unaware of the content, and then making a fuss over the game then that's great.

It's rated for adults, pretty obvious from its name and artwork its for adults, and I haven't seen anything from T2 or R* claiming otherwise. So whats the problem?
he isn't too far off. i've always respected this man. he's wrong, but he truly believes that what he is doing is necessary to protect people and unlike other people he usually is calm and rational when discussing the issue. however, i am dissapointed to see him saying rockstar has a history of deveiving the ratings board. one instance does not constitute a "history," especially when considering the fact that the hot coffee content only saw the light of day because some basement dweller illegally hacked the source code.

like i said, i respect mr. yee. he is entirely justified in saying that GTA glorifies violence. if you think otherwise, you're kidding yourself or you have an ability to bullshit far beyond that of myself. and i don't think anyone here would disagree that children should not be playing this game. urging parents to be aware of what their children are playing is absolutely essential. while GTA isn't a realistic game, he is accurate in saying that the game features violence being enacted upon realistically rendered human bodies. in general, other than the comment about R* deceiving the ratings board I am in complete agreement with mr. yee.

Leland Yee has picked a fight he cannot win, and does not deserve any quarter. Yes, Rockstar fucked up a little too concerning "hot coffee", but he hasn't changed his pecksniffian attitude concerning first amendment rights. The idea that he is still supporting his failed "law" in the appeals court is proof of his ingenuousness and his prevaricating about GTA cannot be dismissed/ignored. Yes, Yee is discommoding and as much as I wish I could vote against him-or could have in the state senator elections, I could not because he is in a different district, despite me being an active libertarian voter.

I expect "News" that will "Support" This claim in the next few days. I can read the final Harry Potter book full of Violence, death, gore, and strong langague (although censored the langage not everything else) and it would be fine. To be quite honest, the somewhat rabid responses from the majority of posters in this thread I find far more concerning than Mr. Yees statement.

His underlying message is one of education for parents, which is something that I would hope everyone could agree with.

All this breathless talk of 'outright LIE' and 'point by point beatdowns' makes us sound exactly like the children that we as an industry are trying so hard to prove that we're not.

PS - Unless i remember incorrectly, Take 2 did initally claim that the content of the Hot Coffee scandal was never part of the game code, which was in fact a lie, or if you prefer a deception.
PPS - As for people prefering Jack Thompson to this guy as their anti-gaming crusader...only someone insecure in their own position would choose a weak opponent.

This is my first post here on GP in a long while. And as much as I hate dragging up the whole Hot Coffee crap again on this site I just had to reply to your comment. Please re read the statement from R* below:

They released a statement actually defending R* despite the fact that nearly everyone else were wrongly claiming that they were trying to pin the blame solely on the GTA modding community. The modders could obviously see what everyone else was too blind to notice that the slime bag politicians like Yee and anti gamers were just using this as an excuse solely to try to ban games like GTA which funny enough they have been trying to do for years now.
ok a little half-truth in there is annoying, sure but Yee is getting more on board with parental responsibility than almost any other politicio around right now.

i commend him for being straightforward, and don't think a press release warning parents to not buy this game is a bad thing.

if he told the parents to READ THE ESRB RATING LABEL it would've been better. why? come on! GTA's not the only violent game. saying "don't buy GTA" only says.. "don't buy GTA", what about the other games? unless parents are taught to READ the labels AND NOT IGNORE THEM, this problem would go away.
@ godofyouall: That's actually pretty interesting...my recollections from the time of the 'scandal' were that were that T2 had to a certain degree denied the whole thing.

Which sort of proves my point I think. I'm fairly young, I work in the video games industry, and I follow industry news pretty closely, and yet still it's hard to keep track of the precise ins and outs of all the pertinent news.

So, today someone who's pretty far removed from gaming culture releases a statement that's soft on some facts, and wrong on others, and yet still maintains a core message that's pretty positive and reasonable: parents need to be aware of what their kids are playing.

Do we:

A: Completely freak out, call them a liar, insult them and totally dismiss them
or
B: Support the core message, and perhaps work to remove their misconceptions

Seriously...unless we as a community start reacting like adults in situations like this gaming will always be viewed as the pasttime of children, and games like GTA will be reviled in the mainstream media.

If Rockstar stood up and defended themselves the full uncut version of Manhunt 2 would be available for retail or at least order from online in the US.

I am glad that GTA 4 is totally uncut in the US yet Rockstar still needed to stand up on the Manhunt 2 situation so people like Leland and Jack Thompson would have a harder time messing with them.

This is like the best thing anyone can say, seriously. If parents want to prevent their kids from seeing anything they consider inappropriate, the best thing for them to do is review the games. It's not hard at all. I review most the games I buy, so i dont waste my money on a game i might think sucks...

The game is rated "M" for Mature. Thats the highest rating there is for the ESRB. Its intended for people 17 and up. The Adult Only rating is purely retarded, it raises the intended age limit to 18... wow 1 year. The politicians that try and push the AO rating are wasting tax payer money on dumbass stuff. It will never prevent people under 18 from playing the game. Itll just mean they cant buy it on their own in some places.

As I said in the "Thompson bashing GTA bus AD" post, theres no doubt theres alot of posters like that one around the city. He chose that one which was close to a park that he worded as "kids' park" to help his cause. Im pretty damn sure it was just a normal park, he just added the word kid for shock value.
This is ridiculous. Politicians lack so much support for their arguments. When was the last time any politician played a video game? But he does have a point about parents; they shouldn't be allowing their kids to play M-rated games at such impressionable ages. I'm 20, and although I started playing M-rated games at as young as 10, I would still strongly advise parents to look into the games their children are playing before making a purchase. I've played a number of online video games in my life, and every time I hear a 10-year-old boy screaming obscenities through the microphone, I can only shake my head in shame. It's disappointing how some parents are ignorant to the influence of video games on their own children.

The Hot Coffee mod does not count as "a history of deceiving the ratings board and the public on the true content of their games." Anyone who saw that went through a lot of trouble to mod it and knew what they were going to see.

Despite that bullshit, Mr. Yee makes a good point by suggesting that parents should monitor what games their kids are playing. I suppose he's not quite as ignorant and stupid as JT.

Well since hookers don't usually have ESRB ratings, thast must mean that the content is 'E for Everyone'

A law must be passed where hookers are required to have the appropriate rating code for their country tattooed on their face
again i feel the need to point out that Hot coffee was not the only ratings misstep to befall a take two game, take two has had at least 2 games which have been released, and then later re-rated with a higher rating

the first of course being GTA:SA with it's infamous hot coffee incident causing the rating to change from M to AO until they changed the game

then the second incident was with 2K and Bethesda's game Oblivion, which was originally rated T, then after it was found to have much more blood and gore then was in the original rating submission video, the game was re-rated to M

in the later case Bethesda took all of the blame, however, it was still infact a take two game, and while granted they really arn't the game makers, they are the publishers and as such they get lumped together as partial creators of both games, which could be the basis for claiming a "History" of deception (granted both were done on accident and not as deception, but thats how he's spinning it)

He starts promisingly enough promoting parental responsibility, but then he turns around and slams the ESRB, the primary source of information for parents who are responsible! Uninformed comments like Yee's serve to undermine public confidence in the ESRB, when it should be promoted and championed in order to get it through parents' heads that this is where you get information about what's in the game.

It's like telling people: "You should eat at least 5 pieces of fruit a day. Fruit however often tastes nasty and is expensive." He makes a recommendation and then cuts the legs out from under that recommendation, hobbling his message of responsibility.
When you say to a child "this is forbidden" it just makes the child wanting it more. Like saying you cant play with toy guns, it will do what it can to get one. Saying that GTAIV is banned just makes it even more exiting... and think you ignorant politicians are just enhancing the advertising of this game. This is something that you guys will never win!
Parents beware:

Yeah, because the difference between an M rated game designed for those 17 and older and an AO game dsigned for those 18 and older is SO great, Take Two is willing to do whatever it takes to snag that one year age difference.
I have been playing M rated games since I was seven and I haven't killed anybody. If I am able to realize the difference between games and the real world so can other people. Now, I'm looking to become a game programer next year and I'm tired of all of this "Dont let your kids play GTA IV" crap in the news every single day of my life. God i hate really hate this guy, he's a grade "A" nanny-statist, hypocrite and two-faced lier who wants the state to come in and regulate every aspect of our lives and our children's lives. Mr. Leland "Mao Zedong" Yee parents don't need you telling them what their children should or shouldn't be watching, reading, listening or playing. They know their kids better then you do. Also maybe you should give kids more credit then you are giving them. Most children aren't so stupid and impressionable to go out and emulate the actions of games like GTA or Manhunt. Most of them have a pretty firm grasp on the difference between reality and fantasy and know that the things you can do in these games should never be done in real life because they are wrong.
The only kids who would actually think it's a good idea to go out and emulate this stuff in real life are those with shitty negligent parents and who grew up in a real-life violent or negative environment so their mental compass is already fucked up. Plus even if the games weren't there for them they just get their ideas and inspirations for criminal behavior from some other form of media or speech such as the 10:00 news and all the crime and violence they show and talk about on it.

Its not just Oblivion, They have done that with World Of Warcraft also, (the adding of breast+nipples+va-jay-jays with a user created downloadable mod) but it still has a Teen Rating...I wonder why they havent been attacked yet. I think he at first makes a good and valid point; parents should & ought to get entgaged in what games their children play. That said, maybe at least some of the 42% mentioned in his Mr Lee's press release, did get their hands on M-rated games, simply because their parents allowed them to buy it. And that is how it should be, imo.

And yes, the GTA game is violent - if you want it to be. As I understand your character, Nico Bellic, is really trying to clean up Liberty City? And to that end he uses violence? or not. My point (and others, too) is that it is you who decide how much violence etc. are to be done in the GTA-games?
However, I agree that the GTA games are not children at all.

Leland is addressing the makers not the publishers. Which means he is referring to the single hot coffee incident.

Also Oblivion was re-rated because Bethesda included the textures for MALE chest areas with the game, then a moder put those MALE chest areas onto the females... That is why Oblivion was re-rated and because even the ESRB realized that such a reason is insane, they said it was because it had more blood and gore then was stated...(even though they knew perfectly well about the blood and Gore)

As for Leland, until now, I thought that he was a rather reasonable guy...
I see now that he is just another Spitzer...
