With Sanctions Hearing Looming, Jack Thompson Accuses Bar Trial Judge of Leaking Documents to GamePolitics

As GamePolitics has previously reported, embattled anti-game attorney Jack Thompson faces a sanctions hearing tomorrow before Judge Dava Tunis in Miami.

Tunis, the referee appointed by the Florida Supreme Court to preside over the Florida Bar's prosecution of Thompson on professional misconduct charges, recently issued a recommendation that the controversial attorney be found guilty on 27 of 31 counts, including "Knowingly making a false statement of material fact or law to a tribunal" and "Engaging in conduct involving dishonesty, fraud, deceit or misrepresentation."

For his part, Thompson has been actively seeking to discredit Tunis, including charging that she is not a valid Florida judge due to her state loyalty oath apparently being signed by a clerk without her knowledge.

On May 30th, Thompson upped the ante against Tunis, charging in a document filed with U.S. District Court that the judge had leaked documents to GamePolitics. Although the name of this website is not specified in Thompson's motion, it is clear from the document's context that he is referring to GP. Thompson writes:

In the last 36 hours, plaintiff has discovered that the referee in the state Bar "disciplinary" proceedings has leaked documents to a video game industry web site that only she had. This has resulted in more harassment of Thompson by "video gamers" who have been threatening to kill Thompson and his son.

 

The referee knew to leak these documents, which only she had, to this particular gaming web site because it came out at Thompson's bar "trial" that this site had filed a Bar complaint against Thompson (which was so bizarre that even this Bar dismissed it) and that this site was in fact orchestrating harassment of Thompson during his trial.

 

This same site had orchestrated postings at Amazon.com, when Thompson's Tyndale House book was published, that there was a "Canadian edition" of Thompson's book in which Thompson disclosed his internal struggles with homosexuality and drug use. Thompson has had no such struggles; there was no "Canadian edition."

There's just one problem with Thompson's charge that Judge Tunis leaked anything to GamePolitics: It is not true. I don't know Judge Tunis. I've never spoken to her, exchanged e-mail with her, or had any contact with her. I did call her office once, many months ago, to inquire as to when we might expect a ruling on Thompson's trial. A staffer referred me to Eunice Sigler, Director of the Office of Government Liaison and Public Relations for the 11th Judicial Circuit of Florida.

GamePolitics has obtained three documents relating to Thompson's case in recent days. All came from public records requests with court administrators.

On May 20th , GamePolitics broke the news concerning Judge Tunis's recommendations as to Thompson's guilt. That document came from the aforementioned Ms. Sigler. I've been tracking the Thompson Bar trial since it took place in late 2007. Months ago I contacted Ms. Sigler and made a media request for any developments. As per my request, she forwarded me the recommendations. These were also published in the Daily Business Review, which apparently obtained them via its own public records request.

The following day, in a filing with Judge Tunis, Thompson alluded to having 33 witnesses that he hoped to subpoena for his June 4th sanctions hearing. Curious about these, I asked Thompson for the names. He refused. I contacted Ms. Sigler on May 23rd and made a public records request regarding Thompson's proposed subpoenas. I received the subpoena document from her on May 28th and published it later that day.

Also obtained via public records request was the Miami-Dade State Attorney's investigative report into Judge Tunis's loyalty oath. This document came from Public Information Officer Ed Griffith.

Thompson may not like it, but he has made himself into a very public figure. His case is a matter of public record. His court filings are not sealed, nor are they classified information. They are a matter of public record, readily available through the proper channels.

In a series of e-mails, Thompson demanded several times to know where I had obtained the documents. Being under no obligation to do so, I declined to tell him. Moreover, he is an attorney. He should understand that these are public records.

Regarding his comments that I orchestrated harassment of him or orchestrated bogus reviews of his book, these are utterly false. I've addressed his allegations on the book issue in some detail in the past, and I've also discussed my filing a 2006 Bar complaint against him. Nor, as Thompson alleges, is GamePolitics a "video game industry web site." Readers need look no further than today's story on E3 and Gov. Rick Perry to confirm that.

So what will happen at tomorrow's sanctions hearing?

It's impossible to know, although Thompson's e-mails of late have indicated that he expects to be disbarred. In any case, Judge Tunis does not have the final word. That responsibility lies with the Florida Supreme Court.

Yes, Thompson is an attorney and he "should" know these things are a matter of public record, but an attorney should also have a clue about court procedures, citing relevant cases in filings to back up your arguments, not slandering your legal opponents and judges, and what the First Amendment actually entails.  Thompson has never displayed any working knowledge of any of these things.

All he is doing is trying to take people down with him. Appearently nobody is buying what crap is coming out of his mouth or fax machine in this matter. Lets just wait and he will shut up after being disbarred, discreadied and dumbstruck.  After his disbarrment the internet will be a buzzed with jokes, you-tube videos making fun of him and probably flash games showing him what a GIANT idiot is was and will always be.

All lawyers should know that court documents are public record.  However, JT did file gay porn with a court- seeming oblivious to this basic fact of practicing law.  After the shitstorm that caused, you would think he would have learned.

BTW, this whole disbarrment thing is going to go on for a long time. Jack is sure to bombard courts, judges, lawyers, the media with all kinds of lawsuits, faxes, and general BS. 

Never forget that this is no longer about videogames- Jack made the entire debate all about HIMSELF years ago.  What happens to him now won't do anything to help or hinder the legality of games. 

The only good thing about his disbarrment is that a bad person is finally getting punished for being a lying asshole.  That happens very rarely in life...

It's fabricated.  Might even be nothing more than his own internal demons talking to him in his head.

All in all it really doesn't matter.  The guillotine will still drop on JT's career tomorrow with a disbarment verdict and there will be no one to blame for the debachle but himself.

Does anybody outside the gaming community know or care who Jack Thompson is? Was he ever taken as a serious threat? HAS HE EVER WON A SINGLE CASE??? If he does not get disbarred, I will lose what little respect I have left for the US legal ststem.

Actually, before he set his eyes on video games he was a pretty effective lawyer who did actually win cases.  He has always been on the 'moral case' horse but he used to actually be good at it.

My guess is that the crazy has finally overridden the intellegence.  Maybe dementia setting in?

He was always.. ahm.. colourful... but at least in the past he knew how to manipuate the law and people to get away with it.  Seems to have lost that.

Thinking on it, any success Jack enjoyed in general practice before starting his censorship crusade was likely a result of probability than of effectiveness on his part. Any lawyer is likely to land a few cases where the only thing actually needed to win it or get a settlement is to be a lawyer. Cases where there was obvious neglience, or breach of contract, etc.

So I wouldn't say that he used to be a "pretty effective lawyer" so much as he used to be a "functional lawyer."

Huh? We must be talking about two different Jack Thompsons. There was never a time, going back to when he failed the bar exam the first he took it, that Jack was "good" at the practice of law. He's been a loser all his life.

Sure people outside the gaming community know and care who Jack Thompson is. We aren't the only ones he's made himself a pain in the ass to over the years. Remember GPs coverage of his trial made a point of mentioning that it did not include various parts that were unrelated to Jack's little "crusade" against games.

I amwith 1AgainstTheWorld on the threat issue.  Stop bothering the man if you are.  I hold a deep seated belief that few, if any are calling his home at all hours and threatening his family.  There was the one child in Texas, but we as a society have learned our lesseons about losing our tempers, and shouting and saying bad things about people....it gets you disbarred.

Furthermore, if there was such concern for his family, why have the police not tapped his lines, recorded numbers...hell, caller ID could tell you where half of these twits, if any, were calling from.  You can purchase a small recorder from most hardware/electronics stores for a pittance, and turn the info over to the proper authorities.  Nothing says "gotcha" like hard proof Jackie boy.

but if true, as a ex-military member, and a 30% disabled vet  of this recent war, i take serious offense to it...

basicly to me it says " the dead guys are the good ones, but anyone who lived and plays games is a sinner"

i can't say i know of anyone in my military days who didn't play "violent video games"

like i mentioned before, we also had Halo 2 tournaments in my squadron! So are all surviving members of the military who play games crazed madmen? and in order to be "good" in jacks eyes we'd have had to DIE in combat first?

that comment would be offensive not only to military members, but family and friends too i'd think...

its either that or its only okay to play violent games if your military, and i doubt jack would consider that option since he's attacked former Military members and claimed their "shooting rampage"'s were based off of vid games (i still can't believe they tried to say the Ex-Marine known most well as the "D.C. Sniper" trained playing Halo.... wtfh?! with all the gun training ya get in the military, it was a game that trained him?)

Man, Johnnie Brucie has gotten hilarious lately.  It's everybody's fault but his, the last flailings of a desperate little goblin.  By now he should have enough rope to hang himself tenfold.

There is a summary of what case is pending against her.  The short of it; a guy who owes her client money is claiming that she assisted in an unoffical manner in a criminal proceeding regarding his violation of parole.  More to it at the website, but I haven't the foggiest why Jackie boy is involved.  For all intents and purposes, she, from what I have been able to find, sounds like a decent lot just trying to get money for her clinet that the defendant owes her.  She might have overstepped her bounds in the process, nothing more.

If you could bottle the scent of Jack Thompson, you could market it as a fragrance. It would be called "Desperation".

 

In all honesty, what did he think he was going to accomplish with this latest charge? To draw attention tot he fact that citizens can make requests of public documents? To try and wring any sympathy out of those who are in charge of his future with these allegations of "threats"? (IMO, more likely e-mails that disprove his lies and disaggree with him).

What is more threatening in my opinion is his little press release about tomorrow's hearing where he says that he intends to "lower the boom" on the Forida Bar. Given that this is the same guy who said he was going to render the Bar like a destroyed city in Hiroshima, that this is the same guy who smuggled a large slingshot into court previously, and given that he is in the pits of desperation, I really hope that he is searched by security prior to entering. I would not be surprised if he tried to shoot the place up and then turned around and siad "Video games and the Florida Bar led to this, my greatest victory, HOOAH!".

I sincerely hope that disbarment is decided as appropriate tomorrow. I don't want the man fined, or criminally charged, I just want to see his ability to file these frivolous court cases free of charge removed and his smug signature of Jack Thompson, Attorney taken from him. It will be like taking the loudspeaker out of the hands of a raving mental patient.

Have to admit to being curious.  How exactly did we (GP) manage to get illegal documents spelling out the doom of JBT and no other gaming site has?  I mean face it.  We was hardly alone in our disgust with all things Thompson.  Where are said documents?  Dennis bless his heart would hardly keep such things from us.  Oh wait.. you mean jackie is a lair and not to be trusted?   Ah I see. 

Oh and btw jackie,  whereas there are some of the more driven (aka demented) types that would like to see you in pain or removed (none that I known personally but the rumors speak of such) None have anything against your son or have threatened him.  Stop trying to hide behind others and face reality and the results of your actions.    Time methinks to dig up the music video link for Sarcasticgamer.com about you foolish one, maybe they should play it at your hearing on the morrow (if you have the gonads to show up).

Considering he failed his bar exam the first time around... and considering how he doesn't know proper filing methods, or submission protocols, or rules of conduct, etc... yeah, I'm gonna guess there's a lot about legal procedure he's clueless about...

The only thing I can really say is that this nonsense would have been avoided if you had simply told him where you got the documents. Yes, acknowledging him is usually the worst way to handle a troll, but it would have nipped this problem in the bud.
