In a four-page written order (download here), the Florida Supreme Court today affirmed a referee’s recommendation to permanently disbar controversial Miami attorney Jack Thompson.

The action, which takes effect in 30 days, means that Thompson will no longer be licensed to practice law and may not apply for reinstatement. Ever.

In citing a litany of offenses, the Court noted Thompson’s extensive pattern of misconduct and cited a "complete lack of remorse." The Court also quoted extensively from the June, 2008 report of Judge Dava Tunis, who served as referee at Thompson’s November, 2007 trial on charges brought by the Florida Bar:

In her report, the referee states: Over a very extended period of time involving a number of totally unrelated cases and individuals, [r]espondent has demonstrated a pattern of conduct to strike out harshly, extensively, repeatedly and willfully to simply try to bring as much difficulty, distraction and anguish to those he considers in opposition to his causes.


He does not proceed within the guidelines of appropriate professional behavior, but rather uses other means available to intimidate, harass, or bring public disrepute to those whom he perceives oppose him.

Noting that "The Court concludes that the facts, as even more extensively detailed in the referee’s report, support the referee’s numerous recommendations as to guilt," the justices of the Florida Supreme Court affirmed Thompson’s offenses as delineated by Judge Tunis.

Some of these include findings that Thompson made false statements and accusations, repeatedly harassed those he considered opponents, and, while falsely accusing others of "the criminal distribution of sexual materials to minors," himself attached pornography to court filings.

  • [Thompson] made false statements of material fact to courts and repeatedly violated a court order
  • [Thompson] communicated the subject of representation directly with clients of opposing counsel
  • [Thompson] engaged in prohibited ex parte communications
  • [Thompson] publicized and sent hundreds of pages of vitriolic and disparaging missives, letters, faxes, and press releases, to the affected individuals
  • [Thompson] targeted an individual who was not involved with respondent in any way, merely due to "the position [the individual] holds in state and national politics"
  • [Thompson]falsely, recklessly, and publicly accused a judge as being amenable to the "fixing" of cases
  • [Thompson] sent courts inappropriate and offensive sexual materials
  • [Thompson] falsely and publicly accused various attorneys and their clients of engaging in a
    conspiracy/enterprise involving "the criminal distribution of sexual materials to minors" and attempted to get prosecuting authorities to charge these attorneys and their clients for racketeering and extortion
  • [Thompson] harassed the former client of an attorney in an effort to get the client to use its influence to persuade the attorney to withdraw a defamation suit filed by the attorney against respondent
  • [Thompson] retaliated against attorneys who filed Bar complaints against him for his unethical conduct by asserting to their clients, government officials, politicians, the media, female lawyers in their law firm, employees, personal friends, acquaintances, and their wives, that the attorneys were criminal pornographers who objectify women.

The Court also upheld a fine of $43,675 against Thompson.

For his part, Thompson offered his standard-issue bluster, announcing his disbarment in an e-mail which carried the subject line "Now the Fun Begins." Thompson has also filed a request with the U.S. District Court for an emergency stay of the FLSC’s order disbarring him.

    Although I don’t fully agree with your feelings (I’m flying higher than a kite), I can understand where your pity is coming from. Watching someone utterly destroy themselves is sad to watch, especially when they’re wholly unwilling to change his ways. Like a lone lemming plummeting off a cliff to its end, all you can do is watch and shake your head….

    However, when that "lemming" threatens your liberties and insults your intelligence at every turn, you kinda wish you could pick him up and hurl him off the edge. I understand why you pity him; I really do. But I just can’t share your sentiment for someone who completely deserves his punishment.

    From that persepctive I can see where some would pity him. However, he had more than his fair share of chances and opportunities to turn things around and do things differently. He chose not to. And based on his response he still hasn’t changed. I hope I don’t sound like I’m attacking you and/or your point of view on this. That is certainly not my intent. Rather I do aggree with you that it is sad he is not going to learn from this.

    So pity? No, I have no pity for him. He is not deserving of pity. If he showed any signs of remorse for his actions or indications that he could or wants to change maybe he could have some pity. Nor do I take joy from this either. I have plenty of other things in my life to take joy in. I do however feel a sense of satisfaction that justice, albeit delayed in my opinion, has been served.

    Yeah, he does still have 30 days, but since he still can’t file anything without another lawyer’s signature he won’t get anything done. Who in their right mind would put their name on something filed by a lawyer who has just been disbarred for inappropriate conduct?

    And, like you said, he’s going to get arrested sooner or later. He doesn’t have his lawyer status to protect him, so he’s entirely open to lawsuits for libel, slander, and harassment.

    No one can say that they didn’t see this coming. Thompson’s behaviour was reprehensible and, according to the ruling, against the rules of the bar. Therefore the only thing they could do at this point was dibar him permanently.

    Of course we’re going to see a volcanic repsonse from Thompson. After all this is just going to be one more bit of proof to him of some vast conspiracy directed at Jack Thompson.

    It’s ironic that a man who wanted his legacy to be that he was the man who destroyed the gaming industry will, in fact, be remembered as man who acted like a jerk to anyone who dared disagree with him. He’ll be remembered as an example to other lawyers of what can happen when you forget the first rule of the fanatic, "when you become obsessed with the enemy you become the enemy."

    In the end though I take no pleasure in what’s happening to Thompson, I pity him. I pity him because he’s so full of anger and outrage that he’s missing the point and, to me anyway, that’s the saddest thing of all. This is not to say that he shouldn’t face the consequences of his actions, far from it. If he’s half the man he claims he is then he’ll accept this ruling and live with it; of course we all know that’s not the case.

    He’ll whine and scream about the injustice of it all and lay the blame of his own actions at the feet of everyone but himself; because nothing is ever his fault.

    At any rate many thanks to the Flordia Supreme Court. This was long over due and maybe now Thompson can get a full time gig on Fox News like he seems to want. Afterall he is their go to "first ammendment expert."

    It’s not over yet… he’s got 30 days, and you can guarendarntee he’s going to milk it for every last hour he has. Even after that, you’re not going to be done with him. He’s still going to be the same lingering childish narcisistic… well you get the idea. In fact, I can only forsee his behavior worsening since now, when it’s all said and done, and when he knows he has no other recourse, he’ll feel completely and utterly insulted because his irreverant self esteem wasn’t protected.     Ignoring this bar on self-submitted filings, respondent has submitted numerous filings in violation of the sanction opinion, including the petition for review of the referee’s report. The Clerk properly rejected each of these submissions. Thus, there being no authorized petition for review filed, and the time period to seek review has passed, the Court has treated this as an uncontested case. The Court has reviewed the 169-page corrected report of the referee filed on July 16, 2008, for sufficiency and has determined that permanent disbarment is merited on this record.     What an idiot.  He effectively didn’t object at all to Tunis’ recommendation because he outright refused to comply with the order that he can’t file anything without the signature of a lawyer in good standing.

    It doesn’t appear he has any ground to stand on for appeal/rehearing given that he effectively pleaded no-contest.

    Of course, there are many things we place warning labels on.  Some seem rather silly. 

    Here’s an example of government silliness:

    NC decided gambling on video poker machines is bad for you.  We must protect the citizens of our state from the bad effects of gambling on video poker machines.  Even police chiefs came out and ranted that video poker players were criminals.  So, the state moved to outlaw it.  Loophole appeared, and it’s sorta still legal, but it seems the loophole might be closed soon.

    Nevertheless, NC brought in the Powerball lottery.  Oh my gosh!  Gambling is good so long as it’s the state and not private citizens who are benefiting from running the gambling system.  It’s great!  It’s incredible!

    The lottery is good.

    Video poker is bad.

    Video poker makes you acriminal.

    The lottery is good for the state and so is good for you but might cause addiction, hence it’s bad, but it’s good for the state so it must be good for you…

    I hope no programmers saw that creation of an infinite loop… oh dear.

    Anyway, labeling isn’t going to protect anyone.  No one buying something like this thinks they are going to be addicted.  If they haven’t been addicted to some other product, they won’t think "First time for everything".  They’ll think "Hadn’t happened before, so shouldn’t happen this time".

    Now, you might put on there "Open ended gameplay involved.  Pace yourself."  Even without "Pace yourself", it still lets a player know about the possibility of a new experience.  Whether it’s online or offline, the potential for a single game to have no end may be an experience someone who has played games with endings may not be prepared for.

    Still, it won’t save every individual who might become obsessed or addicted, no matter how few there may actually be.

    I don’t know when to stop eating when I eat something really good.  I eat till I have trouble walking 10 feet and my stomach is bloated.  But I don’t eat that much when food is decent.  That’s why I’m thin as a stck.

    I don’t agree with putting that on game packaging, simply because EVERYTHING may be hazardous to your health. Too many drinks will kill your liver. Too much caffene can shut down your body. Even too much water can cause a person to die.

    Hi there Brad,

    While I think your comments in this thread are not relevant to the subject, I still think they are quite interesting. I understand and respect your point of view, but I disagree ont one very important point : accepting the "fact" that you are powerless before something.

    A lot of people around me have had problems with a few addictions over the years. Drugs, cigarettes, alcohol, gaming, you name it.

    I have seen that all those who "accepted" their addiction (saying it controls them and they are powerless before it) are those who always had the worse problems. Even worse, I believe it gave them an excuse, a kind of confort zone. Something like "If I can’t help myself, it is acceptable and even expected that I will fall down again". They will blame the companies, society, anything except them.I have seen people around me thinking like, and they are never at peace. Even with therapy (for some, over 15 therapies), they juste can’t get over it. 

    The others are doing the complete opposite. They will never accept their addiction. They will never say it controls them. They fight that every step of the way. And it works. It works really well. They accept that they made the choice.  

    Even someone really addicted to something has a choice. Usually you are not forcefed your addiction. You choose to drink, to smoke, to play or anything else. YOU make the choice. It means you can say no, and saying no will empower you and make you stronger. 

    I think fighting your addiction is the better choice, instead of accepting it. Anyway, you live in a world where your addiction will not dissapear magically. You will see beer and cigarettes at every party. You will see game adds everywhere. Deal with it.   You will be a stronger person for doing it. Of course, it doesn’t mean you have to do it alone. Instead of accepting your addiction, accept your responsability over it.

    Blaming video games for being addictive is pointless. Instead of simply branding video games (or any other addiction) as "bad" and avoiding them altogether, it seems to me that it would be more productive to objectively examine the underlying reasons why you allow yourself to become so involved in something that it becomes harmful to your personal life. Being able to enjoy an activity in moderation seems healthier to me than simply cutting it out of your life altogether.

    Thank you for your replies to my posts on violent content and compulsive game play. Yes, I accept responsibility for my choices. I have learned that I cannot set limits on my game play. As a drunk is powerless over alcohol, I am powerless over gaming. And so I finally found the courage to quit eight months ago. Nobody put a gun to my head, forcing me to play, but I do believe the reward structures and open ended game play of today’s MMO’s are a formula for disaster.

    It’s interesting to note that one of WoW’s load screens encourages players to enjoy their time in the game, but not to forget their real life responsibilities and relationships. (It’s been ten months since I played, so I don’t remember the wording).

    An informal poll. How many would support the following language on retail packaging. Please give a ‘Yes’ or ‘No’ with a brief explanation. Thanks in advance for your interest.

    1.  No, the ESRB isn’t giving the "intended result" for one reason:  Because that’s NOT the intended result.  The ESRB is there to INFORM, not DICTATE, to individuals and Parents what is or is not appropriate for their children.  The same is true of the MPAA and the TV ratings system.  The ESRB doesn’t REQUIRE anyone to abide by their ratings.  The decision of retailers to follow those ratings in the sale/rental of any product is voluntary.  Merchant associates don’t force retailers to have policies either.  The Merchant associations only require a retailer to have a policy for the retailer to be a member of the Merchant association.   Contrary to popular belief, Parents DON’T need to be dictated to.  They only need proper information and resources.  Information and resources already exist.  But Tin-Pot-Dictator-Wannabes want the power to decide FOR individuals and Parents, so they do their best to limit Parent’s knowledge of that existing information.

    2.  Graphic violence in ANY media format (books, music, video/computer games, movies, TV, etc) are in fact peripheral.  Far more damaging to society is the active teaching of bigotry, hate, justification of abuse, and the general acceptance or fear to report various abusive acts in the schools, homes, neighborhoods and community at large.  The teaching of bigory and hate as "moral acts" in the name of a God.  The attempts to prevent abuse victims from having support systems or claims that verbal and mental abuse because of religious justification is protected speech (which isn’t the same as the Right to believe in bigotry and hate without abusing others).  This and many other things have far more direct harmful effects than what one is peripherally exposed to.

    3.  Less so than the church (in general since you say the game industry in general) has to deal with the role of select religious groups and their active role in teaching bigotry and hate as a "moral" way of life.  The fact is, not everyone who attends church are exposed to bigotry and hate.  Not everyone that is exposed to bigotry and hate become activists.  Not every activist becomes a violent abuser of others.  Just as not everyone who is exposed to Media X product, sub-catagory X, genre Q, sub-genre P will have reaction XYZ and act PDQ.  The fact is, YOU had a bad reaction to something.  YOU need to stop blaming everything else and take responsibility for that bad reaction, even if it wasn’t voluntary.  Even gamblers fighting their addiction know it isn’t the horse’s fault they became addicted.

    The last one (MMO addiction) is flat out a personal problem.  Some people get addicted to food because it tasts so good, get fat, and tend to have heart problems and die, while the large majority of people understand that food is great, but know when to stop eating.  Same goes for games like MMOs, they are great, but you have to know when to stop.  It isn’t that hard, keep a clock by your computer that you can see at all times, set a time that you will quit playing, and quit playing at that time or sooner.  NO only 10 minutes more, or just this one last thing, you are done, if you finish a quest or something 5 minutes before your goal time, then stop there, no more.

    If you don’t have the self control to not get addicted to these games, then I have to call survivle of the fittest personally.  I feel bad for the families, but there are so many addictive things out there that they could be getting hooked on and dieing from instead.  No addicion is good, but anyone with half of a brain can manage game addition if they want to, all it takes is a little self control.

    I introduced my viewpoint in a post last night. While I’m glad Thompson’s disgraceful behaviour has warranted disbarrment, the time has come to begin a serious dialogue on some important issues:

    -Are the ESRB ratings giving the intended result – keeping mature content out of the hands of young children?

    -What – if any – are the real social consequences of graphic violence in video games?

    -Does the gaming industry have a role to play in dealing with what seems to be a growing problem of compulsive play in the MMO genre?

    Again, Thompson’s departure from the scene is a breath of fresh air, but it doesn’t make these questions go away. Hopefully it just makes reasoned, intelligent discourse possible.

    Mr. Career had been seen by so many specialists.  But it was Dr. Tunis who finally diagnosed the terminal illness that would eventually lead to Mr. Career’s passing.

    So tragic.

    And there will most likely be those who will blame media of all types for the illness.  Those who would feed off this tragedy and use it to their benefit.  Most notably will be the very being that Mr. Career tried to serve and was so brutally abused and tortured by.

    Still, there are many who know who is to blame for Mr. Career’s demise.  And though the monster, whom Mr. Career attempted to serve, that committed such atrocities against Mr. Career will continue his atrocities without Mr. Career supporting it, we all know that Mr. Career is now in a better place.

    He will have more time to waste on his anti-game crusade, but you’re forgetting how he runs his crusade. Jack spends most of his time harassing and slandering people. Now that he isn’t a lawyer, he’s a lot easier to hit with lawsuits. Being a lawyer gave him a little bit of space to annoy people; without his title he’s open to all sorts of restraining orders and defamation lawsuits. If anyone gets a restraining order against Jack, Jack will probably break it within a week, leading to fines or jail time. He’ll either end up as another crazy homeless man or someone’s loveslave. Either way, he’s out of the picture and completely discreditted.
