Netflix said recently that it is not pleased with Internet service providers looking for new ways to charge users by the amount of data they use. Of course Internet service providers claim that they have to switch from flat-rate monthly data fees to usage-based pricing models to pay for network upgrades and prevent consumer congestion.
"Wireline bandwidth is an almost unlimited resource due to advances in Internet architecture," Netflix General Counsel David Hyman wrote in a recent Wall Street Journal editorial.
Netflix has argued against usage-based billing in Canada (as have consumers) and in the U.S. it has complained to the Federal Communications Commission that UBB could curb Internet use or leave consumers with confusing bills and penalties for going over their limits.
"With online-content delivery providers like Netflix and voice services like Skype experiencing explosive growth, competitors see consumption-based billing as a convenient way to slow that growth by making the use of online services more expensive," he added.
Hyman went on to write that the cost of adding an extra gigabyte of data is about one penny for ISP’s.
Naturally Netflix has a vested interest in this topic because usage-based billing could curtail usage of its popular service. Given that a good portion of Internet traffic is being used to stream movies over the service via various platforms, it makes sense that usage based billing schemes by ISP's could cut into Netflix traffic.

Until every ISP and Telecom complies with Federal Law, they have NO LEGAL STANDING to implement usage-based billing:

Nor do these companies have any sort of right to complain when a Netflix or YouTube comes along and starts chugging bandwidth that should already exist. Usage-based billing is a fantastic way to never have to upgrade your network because that is EXACTLY what these companies plan on doing if they get their way.

It's awfully convenient how UBB used to be about ISPs doing their bit to curtail piracy, but with the rise of legitimate bandwidth-heavy applications, it suddenly became about maintaining and upgrading the network.

An honest real-world example of why we need better networks. ISP's are trying to squeeze every bit of profit out of the existing network so they don't have to invest in a better network. Not only that, but as internet service gets faster, online services such as Netflix competes directly with ISP's other legacy services (cable and VoD). So they try to kill them off with UBB.
"Sorry, you used 10GB of data last month using Netflix. It's going to cost you, but we'll sell you the exact same service for a higher price, but it won't count against your bandwidth allotment."

And mentioning monopolies being part of the problem, we do need real, true competition instead of an ISP managign to get a stranglehold on an area. It's too easy to charge whatever the hell you want if your customers have nowhere else to go.

I'm pretty sure they just made all that up to sound technical so that people won't ask questions.
Also, Netflix just did a good job evaporating my interest, and I was considering trying it on my PS3.

I doubt that's really their concern. Plus if someone chooses to not use Netflix for a month can they still charge, or will they come up with fees for chosing not to use their service so your bill is lower?

You are charged monthly regardless of actual useage.
Personally, If I was Netflix I would be concerned that my customers would cancel their service rather than risk higher internet bills because of usage.
I know as a Netflix customer, I would be very wary if I had usage based billing. I am already concerned that the US postal service cutting to 5 day a week delivery would impact my usage of the dvd mailer. Usage based billing would compound that and I may have to cancel if I can't use it the way I want.
