A new class action lawsuit accuses Microsoft of double billing its customer for Xbox Live subscriptions. Ryan Graves of Bloomington, Indiana has filed a class action against Microsoft in U.S. District Court in Seattle, alleging that the Xbox 360 creator double-bills its Xbox Live members and auto-renews subscriptions without their consent.
Graves' suit also alleges that Microsoft's prepaid subscriptions are "governed by vague and onerous terms of use," which Microsoft uses to double-bill people who do not renew their subscription before it runs out. Further, his suit claims, if the customer tries to renew, Microsoft charges for both the new subscription and the renewal of the old one.
Graves also claims that when he brought the issue to the attention of Microsoft, they told him that they thought the issue was resolved and that they would give him two years of Xbox Live membership. Graves claims he did not order two years of service and wanted no part of what Microsoft was offering.
The class action seeks restitution, statutory, treble and punitive damages for breach of contract, unjust enrichment, conversion and violation of the Electronic Funds Transfer Act. Graves also wants the to court to issue an injunction requiring Microsoft to "reverse all unlawful, unfair, or otherwise improper charges, and to cease and desist from engaging in further unlawful conduct in the future."

Sad part is, this is actually fairly common for persons who use CC billing. They don't make cancelling your memberships easy, either. I'd actually say it would've been easier to cancel an AOL account a few years back.

I was double billed. I noticed when I tried to remove an old credit card and it wouldn't let me. I called to see what was going on and they said that they tried to bill me for another month of Xbox Live Gold which was incorrect because this was the time when they removed the option from canceling live on the web site and forced you to call in and I called in two weeks earlier before my time expired but I kept getting emails around the same time talking about how Micrsoft was still trying to bill me?
I had this but they wouldn't buy it. I paid so I wouldn't go to collections for a service they never extended me for and even when I paid I never got gold for another month. I hope this suit goes through
