Microsoft, Datel Settle Lawsuits

Microsoft and Datel have decided that it would be in both companies' best interests to settle their Xbox 360-related lawsuits against each other. The two companies have been locked in a legal battle since 2009, when Datel accused Microsoft of engaging in "predatory conduct" after an Xbox 360 update rendered all unauthorized storage devices and third-party memory cards unusable. Datel's Max Memory line of cards were among the devices affected by the update.

The UK-based peripheral and accessory maker filed an antitrust lawsuit in a San Francisco court that same year, claiming in its court filings Microsoft had "deliberately harmed competition" with the change. The company also claimed that Microsoft implemented the update with "no visible purpose other than to have that market entirely to themselves."

Microsoft filed its own lawsuit against Datel in 2010 in a Seattle court, alleging infringement of its Xbox 360 controller patents. The publisher claimed in its court filings that Datel's Turbofire and WildFire controllers violated a patent for a protocol used by wireless accessories and consoles.

Datel redesigned the controllers and halted all imports of the TurboFire2 Xbox 360 Wireless pad to the U.S., and Microsoft subsequently withdrew its case but it continued to seek an unspecified amount of damages for past infringement.

While both of those cases have been settled, terms of the deal were not revealed. Microsoft spokesperson Kevin Kutz told Bloomberg that the terms were "to the satisfaction of both parties."

Glad that's settled, but does Datel have the ability to make 3rd party memory cards anymore?

This is the reason why I sold my PS3....seriously it is not worth it to buy a system that makes you pay to go online and forces you to buy accessories from only MS when the products are cheap and break easily. I have bought six 360s during its life five died the accessories die as well for example the 360 controller adaptor for the PC. Sony has the same problem with Vita it's too expensive and now they are follow MS and failing

You bought 6 360's?  I had the red rings a few times as well, but the full replacement warranty the MS instituted when the problems started meant that I paid for none of the replacements.  If you seriously bought 6 systems, MS made more money off of you by making you angry at them than they would have made if they had kept you happy.  Weird.

Depends on when he bought them. For the first few years (when the failure rate was the highest) MS refused to repair any systems outside of the regular 30 day warranty. Even after their first "generous" offer of extending the repair date, they would find any excuse to say that the issue was the fault of the user and not the company so they still wouldn't have to repair them. It took a massive consumer backlash (at the time a 30% failure rate was not uncommon) before Microsoft relented and allowed full repairs on systems regardless of purchase time or condition outside of physical abuse. Bear in mind this was 4 years after launch when this finally happened.

True for some perhaps, but he stated that it was six purchases over the life of his single PS3.  And if you are insinuating that he bought them all before the more generous warranty plan, that doesn't look much better for him.  Who spends over $1000 replacing a console over and over?  Wouldn't you think he'd get the hint?

I am sorry I am dyslexic when I said PS3 on top I meant 360. I get things mixed up excuse me.

Well every 360 Version Made a better version was made. Mainly I bought these consoles for kids and of course the wife. With the PS3 I've been able to maintain and upgrade my system with 3rd party products to further enjoy my system.

Right now my PS3 has a laptop HDD in so I have a crap load of space. I use my Jawbone Blue tooth and it works like a charm. The only thing that's really needed is the PS3 Controller Keyboard.
