Did Apple Fake Evidence in the EU iPad v. Samsung Galaxy Tab 10.1 Case?

An article on Webwereld.nl posits that Apple may have falsified evidence it used in its court case that led to Samsung's Galaxy Tab 10.1 being banned in the European Union. Apple's main argument in that case is that consumers have a hard time distinguishing between the Galaxy Tab and the iPad. The evidence in question is a photo of the iPad side-by-side with the Galaxy Tab. In the picture it looks like both devices are of a similar size.

The ongoing legal battle between Apple and Samsung, which has seen the Samsung Galaxy Tab 10.1 banned from sale anywhere within the European Union has taken another unexpected turn today. It now appears that Apple may have doctored evidence so as to make the Samsung Galaxy Tab 10.1 look as though it impinges upon the iPad design more than it actually does – at least according to one tech web site…

The main point of Apple's claims against Samsung is that 80 percent of users surveyed cannot tell the difference between both brand's tablets.

The image (found here) was submitted by Apple to the court to illustrate that point, but some digging by Dutch site Webwereld.nl suggests that Apple may have edited the images.

According to Webwereld it appears that Apple cropped and distorted the image of the Galaxy Tab 10.1 to make it look closer in size to the iPad 2. As the site points out, a Samsung Galaxy Tab 10.1 has an aspect ratio of 1.46. The one shown in Apple's evidence appears to have an aspect ratio of 1.36, much closer to the iPad's own 1.30 ratio. The Samsung logo was also removed.

As the site points out, this simply could be a mistake by whoever put the evidence together and may not necessarily prove that Apple did this knowingly or deliberately in an effort to deceive the court..

    Going to actually edit this after looking at things other than Samsung's website, you're actually right. Some of the colors do NOT have the Samsung logo on them.

    Also, as for the aspect ratio, some of Samsung's own promotional material has the same aspect ratio as Apple's evidence. For example, this image used on a number of different Google shop entries, and also serving as the category icon for Tablets>Samsung, and Tablets>Samsung>Wi-Fi Only, matches Apple's evidence, but is clearly not the same image.

    Well, the thing is, the brand name is on the actual product, it's just not on the image supplied to the courts. I'm wondering if the resizing made it look squashed and that was why it was removed.

    Seems like 80% of people need to flip the damn thing over and see the Apple logo (or lack thereof) on it.

    By Apple's argument my monitor could be confused with an iPad too.  Black bezel, lots of little icons in a grid pattern…

    Thing is, I find it hard to believe that removing the Logo so completely could be an 'accident', and having 'Samsung' right there in front of the users face would have been a good hint that it wasn't an Apple product.
