Google’s Motorola Files Appeal of ITC Decision on Xbox 360 Exclusion Order

According to a tip sent over by Foss Patents, Google has appealed Motorola's loss to Microsoft in its ITC patent case which sought to have the sale of its Xbox 360 banned in the United States.

Google is trying to get the decision on the ITC exclusion order claim against Microsoft's Xbox 360 gaming console overturned through an appeal. Foss Patents doesn't believe it will succeed because it faces "procedural and substantive" hurdles, but believes Google is going the extra mile because it has yet to be all that successful with the patent portfolio it obtained when it spent $12.5 billion to acquire Motorola Mobility. The company purchased the company mainly for its patents, which it has tried to use against Apple and Microsoft in court.

The information became publicly available late last week, revealing that Google's Motorola Mobility had filed an appeal with the United States Court of Appeals for the Federal Circuit on July 17.
